yep uh so the uh current application uh

before the board uh is a proposal to

14:34

expand the existing uh Supportive

14:36

Housing family uh use um that has been

14:40

uh has been and will continue to be

14:41

operated by gensia um to more than eight

14:44

individuals uh and to request relief

14:46

from the associated off street parking

14:48

requirements which requires approval of

14:50

a special exception from the zoning

14:51

hearing board alternatively they are

14:54

requesting to be allowed to provide the

14:56

required off street parking at a

14:58

property located from further than 500

15:00

ft per section 7- 327.5 A of the zoning

15:03

code which requires approval of a

15:05

variance from the zoning hearing board

15:08

um so the the first issue and I would

15:10

say the principal request um before the

15:12

board here is requesting relief from the

15:14

um off street parking requirements uh

15:16

for um a Supportive Housing family use

15:19

um the uh off street parking

15:21

requirements are um one uh space per uh

15:25

unit and uh units are bedrooms in this

15:27

kind of uh living arrangement

15:29

um and so overall there will be nine

15:32

bedrooms uh on the second and third

15:34

proposed bedrooms on the second and

15:36

third floors of the property um and so

15:38

they would be required to have uh nine

15:41

off street parking uh spaces uh there

15:44

are two spaces on site accessible from

15:46

kelker Street um and um in reviewing

15:51

this uh I know I knowe that the uh zp

15:54

solicitor read into record a prior case

15:57

uh and the reason that that was

15:58

presented um was to kind of give some

16:00

background to uh the issue and because

16:03

um the off street parking previously um

16:07

uh I guess agreed upon in that case um

16:09

is no longer being provided and so this

16:12

is kind of um being reviewed in in light

16:15

of that as well um and in that earlier

16:17

case from 1998 um the applicants had

16:20

gotten approval for relief from

16:22

providing the off street parking um on

16:24

the specific property uh with the um

16:27

understanding that they would secure to

16:28

two spaces at the association of the

16:30

track County Association of the blind

16:32

which is the property just to the North

16:33

in kelker Street and two spaces at

16:35

another property um owned by the

16:37

applicant at 1910 North 2 Street uh the

16:41

um property the Tri County Association

16:43

of the blind has been um sold and uh

16:46

presumably uh the lease for those spaces

16:49

terminated um and it should be noted

16:51

that the um applicant is also um

16:53

intending on uh selling the property at

16:56

1910 North Second Street uh they do have

16:59

another property at 2043 North 2 Street

uh so they do have another um property

17:05

relatively within the vicinity of this

17:07

property at which parking can be

17:09

provided if so required by the uh board

17:12

um you'll note like throughout the case

17:14

report and then the uh resolution uh it

17:17

mentions that it's just outside of the

17:18

500 foot range that's on the that was on

17:20

the presumption that it would be

17:21

provided at 1910 North Second Street but

17:23

upon further discussion with the

17:25

applicants they had indicated that uh

17:27

that is that property will is for sale

17:30

um and so uh if the parking need to be

17:33

provided elsewhere off site uh it could

17:36

be provided at 2043 North 6 Street um

17:39

now uh the real approximate issue when

17:41

it comes to this is the fact that uh the

17:44

residents are not permitted to have

17:46

vehicles um so really uh when it comes

17:48

down to it the uh only vehicles that

17:51

will be on site or will be driven to the

17:54

site will be for staff um and they have

17:57

uh staff who rotate um around 24 hours a

18:00

day uh in shifts around the clock and I

18:03

think they had noted during their

18:04

Planning Commission testimony that there

18:05

would only be approximately two um staff

18:08

on hand at any one time and they can

18:10

provide a bit more information about

18:12

what those Staffing levels look like uh

18:14

but what that means um from a practical

18:16

perspective is that the two spaces that

18:18

they do have on site are actually enough

18:20

to accommodate uh the needs of the youth

18:22

regardless of how many um individual

18:24

residents are on because none of the

18:26

residents are able are permitted um

18:29

by their regulations to own uh or to

18:32

have vehicles on site this is not

18:34

something that's just like a discouraged

18:36

type of thing it's a requirement of

18:37

their stay there so um while the uh

18:42

request is effectively for um seven

18:45

relief from seven of the required off

18:46

stream parking spaces um due to the

18:49

nature of the operations um and the

18:52

prohibition against tenants zoning

18:54

vehicles uh the planning Bureau U and

18:56

the Planning Commission do believe that

18:58

the

18:59

um applicants have met their burden of

19:01

proof uh with that being said uh the

19:04

Planning Commission recommends that the

19:07

uh zoning hearing board approved the

19:08

request for the following reasons uh the

19:10

applicant has submitted two alternatives

19:11

for providing relief from the requested

19:13

expansion of the existing support of

19:14

housing family use a proposal which

19:17

would otherwise be permitted by right uh

19:19

both requests are reasonable given that

19:21

the residents are not permitted to have

19:22

vehicles which will reduce the potential

19:24

impact from the expansion of the

19:26

facility's occupancy and that the

19:27

alternative alternative site for the

19:30

provision of any required off street

19:31

parking is located um outside of the

19:34

allowable 500 foot buffer and in

19:36

discussions with neighbors they've

19:37

indicated that the applicant's facility

19:39

has been a benefit to the neighborhood

19:41

and that they appreciate the informal

19:42

surveillance provided by residents on

19:44

site and expansion in the number of

19:46

residents should increase the positive

19:48

impacts of the existing facility

applicant and I I did give my card to

this I will

well uh Gia has been there uh and it's

20:33

been a residential facility for us

20:36

for 30 years or so a couple different

20:39

uses over those years uh and with the

20:42

Restriction of eight I can tell you that

20:44

we've been uh offering services at that

20:47

facility for the most part at a loss

20:49

that is any uh program that requires

20:52

stamping 24 hour stamping you do the

20:55

mask you know for DM from uh funding

21:00

that we get for providing the

21:04

services has us operating out a loss um

21:08

Mr Slinger could you explain what

21:09

actually the use is what we're doing now

21:12

uh sure uh now is a program for women uh

21:15

it's a um sort of a it's a licensed U

21:20

step down facility for women who

21:22

completed drug and alcohol treatment

21:23

already this is a facility where they

21:25

can come and stay uh but are free to go

21:28

out for

21:29

work most of them don't have cars we

21:31

tend to deal with

21:33

u people Medicaid

21:37

fund uh burn all the bridges in their

21:40

lives so they're not showing up with

21:41

cars to begin with but it's a

21:43

opportunity for them to get their lives

21:44

back together there um they stay for 3

21:48

to six months and and

21:51

then move on their Liv and we and

21:54

actually we have a very formal

21:56

graduation process

21:59

um do any of your residents work while

22:01

they're at the house yes yeah some go

22:04

after to

22:05

work

22:07

and and I believe it was in the

22:09

application um director Knight said this

22:11

but the residents of this facility are

22:13

not permitted to have vehicles

22:16

no uh is there adequate public

22:19

transportation in the area for them to

22:21

get is and does godena provide any

22:25

shuttle service to doctor's appointment

22:29

job anything like that uh yeah if people

22:31

uh need some you know if if the most

22:34

practical thing is to either like say if

22:36

someone is new in the program they don't

22:37

have uh money we may help help them with

22:40

public transportation to to go to job

22:42

inter Etc but uh if there's uh

22:47

assistance that they need we do drive

22:48

people to various appointments doctor's

22:51

appointments

22:53

or appointments

22:55

with legal appointments whatever

but they also do go since at this level

23:02

of care since they're allowed to come

23:03

and go for the most part they go to

23:05

their things on their own but times

23:08

be and um director Knight reflected a

23:12

conversation that we had that was based

23:14

on conversations I had with neighbors

23:17

the comment being that having the

23:18

residents there adds an additional layer

23:20

of security uh just sort of some eyes on

23:23

the

23:24

street are there actual security

23:26

measures do you have security cameras

23:28

yes all of our gzi has invested a large

23:32

amount of money in security cameras we

23:34

have security cameras at all of our

23:36

facility uh that are that we can monitor

23:41

remotely and they've been very helpful

23:44

in all kinds of areas I I can't tell you

23:47

the number of times I've been called by

23:48

police about the security cameras

23:50

outside of our not this facility but

23:52

throughout our agency that uh you know

23:54

like in my office in nstown I've gotten

23:56

calls about the cameras outside

24:00

been asked to provide footage to the

24:03

police which I have done personally at

24:11

least um before I go through the the

24:15

nature of the request why we're here

24:17

tonight special exception

24:18

request does the board have any

24:20

questions for Mr Slinger regarding the

24:23

operation of the facility at 1728

24:30

Mr SL what's your position you you work

24:32

for goodenia right what's your position

24:34

there my position now is I'm chief

24:37

executive for Real Estate I've been a

24:38

genen for I'm actually a graduate of

24:41

genen I came to genen into treatment 43

24:45

years ago oh and uh I've been working

24:47

there for 41 years right and I've had

24:51

many different positions over those

24:53

years so I I was involved in buying when

24:56

we bought this building and when we

24:57

renovated building and and open that

25:00

program and for this um you were talking

25:04

about public transportation that

25:07

sometimes you know you may provide a

25:08

shuttle but otherwise what they would be

25:11

able to catch a bus right that that's

25:14

mainly how they would probably get

25:16

around yeah all

25:20

right

25:22

and this is it's not uncommon that you

25:24

know that the fact that we heard

25:26

positive uh comments from the neighbors

25:28

of course many people when we first try

25:30

to open programs are nervous about what

25:32

we do and the kind of services that we

25:33

offer but that is a very common uh

25:36

because G has 100 locations in

25:39

throughout Pennsylvania and so other the

25:40

states and uh it's very common that

25:43

after we open people change them they

25:47

realize that we are actually a

25:49

positive for

25:52

in and when you said right that they're

25:55

in the question was that they are not

25:56

permitted to have vehic Les is that

25:59

something

they sign or do they just yeah I mean

26:03

it's there's no way to could have

26:04

vehicle fa without you know without us

26:07

knowing it and um we uh you know

26:10

obviously we monitor people's comings

26:11

and going we we have cameras around the

26:13

whole facility inside and outside it's

26:16

um and it's not like I said it's not

26:17

really an issue because the nature of

26:19

the client that we deal with they don't

26:20

have CS right that's what I was thinking

26:22

to okay even even if we didn't have the

26:25

role they wouldn't have C it's not part

26:27

of their

26:29

reality for the most part right they

26:30

wouldn't right have the means or

26:32

whatever okay and and one thing I think

26:35

that's important to note is this is a

26:38

service that is serving this community

26:41

uh Gooden used to actually have a

26:42

facility at the former state hospital

26:45

that had to be closed um so there there

26:47

is pressure on the existing facilities

26:50

that they have which is part of the

26:51

nature of the request um but so

26:54

essentially as as director Knight went

26:56

through we have situation here where we

27:00

have a use that does not require the

27:02

required parking required parking is one

27:04

space per unit a unit is a bedroom we

27:06

have nine bedrooms um that is different

27:09

than under the the prior ordinance there

27:10

was was looking at the number of people

27:12

and staff but that's what we're looking

27:15

at right now section 7

27:18

3278 of the code allows the zoning

27:21

hearing board on a special exception

27:23

appr gloval basis to reduce uh the

27:27

number required par spaces when

27:29

appropriate um there are there's a list

27:33

of five criteria and it's not an and

27:36

it's an or or Andor so right um the

27:39

first is that there's adequate

27:40

commercial and public parking available

27:42

in the

27:43

vicinity there is adequate parking

27:45

because we don't need any parking

27:46

because our residents aren't cars I mean

27:48

it is it is at certain times of day

27:50

certain times of the week it is can be a

27:53

challenging place to park and there were

27:55

some spaces that were lost right at this

27:57

intersection second and kelper when the

27:59

roundabout was put in but there is

28:02

adequate parking provided because we

28:05

don't need any we have two spaces on

28:06

site we have on average two employees on

28:09

site actually on the weekends it's only

28:11

one um second is that there's uh public

28:15

transportation is available and that

28:18

that it is adequate um and that there

28:21

another potential is that there's uh

28:24

either car share or some other service

28:27

that's provid provided and that's the

28:29

gardenia shuttle which is available as

28:32

needed so

28:35

um personally I think that that there

28:38

are there's justification for the

28:39

request I think there's justification

28:41

for considering and approving the

28:42

request it is a special exception um so

28:45

the board obviously has the legal

28:47

requirements uh that the chair went

28:49

through um since section

28:53

73236 subsection B there's seven

28:56

criteria

28:58

um one is that the use is not clearly in

29:01

conflict with city ordinances the

29:03

ordinance actually provides for this so

29:05

it

29:09

isent um the use has to include proper

29:12

traffic Ingress and egress uh the

29:15

vehicles and pedestrians we did put in

29:17

the application there are multiple

29:19

entrances to the building there is

29:21

Street access you know curb cut for the

29:23

parking spaces that are off of Felker

29:25

street so there I believe there is

29:27

proper rested property

29:31

um we have to show that there will not

29:33

be a significant public safety hazard

29:35

including fire toxic or explosive

29:37

hazards this is at its hard residential

29:39

use that has been conducted for decades

29:42

I don't believe that

29:43

it provides any Hazard um the fourth

29:47

criteria is that the use will not

29:50

negatively affect or significantly

29:51

affect the neighborhood or the zoning

29:54

District in which it's located this use

29:56

is permitted by right

29:58

there's no construction composed that is

30:01

proposed basically looking at expanding

30:03

the use inside the building rooms that

30:05

are already there so I would not see

30:07

that there' be an impact on the

30:09

character of the community fact on part

30:11

of the community now

30:14

um plant screening walls BM sight layout

30:17

again there's no construction proposed

30:19

so that doesn't really apply in this

30:22

situation um Environmental Compliance

30:24

standards performance standards in

30:26

section six

30:28

we don't it's not an issue for us

30:31

cleaning equipment to clean the bathroom

about it um and as far as a historically

30:37

significant architecture you to show

30:39

that any changes will limit minimize any

30:43

changes to it's historically significant

30:45

I don't believe that the building is

30:47

historically significant but it is

30:48

interesting

30:50

um said a mix of vernacular Styles um

but regardless there's no changes

30:56

proposed to the Bild so I believe that

30:58

the applicant has satisfied the criteria

for the granting of a special exception

and it'll be appropriate for the board

31:04

to consider

that anybody else

and uh you know because we a large agcy

of facilities we can at any given time

we can can have the facility that money

year after year but ultimately that

becomes problematic and I think this

facility has lost money every year for

quite some time um and you know it's

subsidized by other facilities that have

32:18

positive uh but uh it's it's almost

32:22

impossible to run a facility for eight

32:24

people with 24-hour

32:26

staing um

32:29

we don't see much that the

32:32

um and yeah we haven't really decided

32:35

exactly how many people you have to

32:37

figure out you know how many offices

32:39

need you know we'll obviously comply

32:41

with whatever the space requirements

32:43

are but but to that point in the

32:46

interest of cander to the tribunal um

32:49

the number 12 was a relic of a prior

32:53

application from

32:55

2006 the the current zoning basically

32:58

requires that the use has to comply with

33:01

code building code and code uh the

33:04

requirement is that there if you look at

33:06

the bedrooms there has to be a minimum

33:08

of 50 square feet per resident per

33:11

bedroom um that's actually less than the

33:13

state

33:14

requirement property and the applicant

33:16

are licensed by the state state actually

33:19

requires 60 square F feet per per per

33:22

per resident per room so uh the request

33:25

is is potentially for more than 12

33:28

based on the the codes that exist today

33:32

for the

33:37

us we do get I I don't know uh where all

33:42

the referrals come from they would come

33:43

from the the county or from uh another

33:47

govern could come from other Deni

33:49

facilities that they completed treatment

33:50

there or could be from another drug and

33:52

out treatment facility where they've

33:53

contined treatment um there's an

33:56

outpatient well with the the par is two

33:58

and a half blocks up the streets right

33:59

across from the governor's mansion

that's an alation facility so there's

34:04

there's a a wide Network yeah Gia has

34:06

operated drug and alcohol treatment

34:09

programs and services in Harrisburg

34:12

since around

34:14

1972 uh we had Pro we have currently we

34:17

have a place on chamille road inara we

34:20

have a place at 2835 nor Front Street we

34:24

have the we have an outpatient in mburg

34:27

uh we have an alation up Second Street

34:32

we have an apartment building next door

34:33

to

34:34

that um and we used to have F programs

34:39

on the ground to the state hospital

34:40

which we had you know we've been told we

34:43

had to close them like 15 years ago but

34:47

it's finally happened we're we're out of

34:50

there the uh other property that uh 2043

34:56

North Second street is that the one that

34:58

you were just mentioning that's like a

35:00

couple of blocks two and a half

35:03

blocks um it's a little further I think

35:05

than two and a half blocks from this

35:06

location but right the one that they

35:09

were talking about before that was just

35:11

beyond 500 feet is the other that other

35:13

one that's 1910 the other are 2039

block yeah like we said most of the

parking needs are going to be met there

could you know sometimes it could be you

know occasionally there might be three

people a with cars if that's third you

know we can clearly say to people that

don't two two cars park there if there's

more than two there then you have to

up and that facility has 14 spaces

um I've been driving by it on my way

home uh it's usually just four four or

five spaces are occupied that and

there's a there's

a a dumpster in one of the spaces but so

how far is that I mean

that's beyond well you know farther than

wasn't two the two on site then you

offer them which they turned down then I

made them a significantly higher offer I

tripled my first offer and they didn't

even respond I talked to the

U cleaner across the street about so

is I mean I think it depends what time

of the day you're there but um there is

uh parking along one side of kelker

having driven around just at various

times of the day you know there is

occasionally on Street spaces there and

there may be on straight spaces um on

Second Street as well generally further

to the north and uh along the front edge

of the um Association of the blind

building I think you generally find some

you know a space or two I also went to

the

exposed restaurant the other side and I

can see they

can't well the immediate neighbor to the

37:38

west

um it's it's an interesting building you

can park underneath it and there's

37:43

parking behind it and share a property

line and our building actually right on

37:46

the property line and there's probably

37:48

11 spaces a buing the building and they

37:52

had no interest in no and I there's

37:55

still a couple people I reach out to

37:57

like Mari that is similar nonprofit

loation has a place right at second in

38:03

right at front in the that same block

and I haven't spoken to I've tried to

call them a couple times although they

38:11

they they looks like they have a for l

of about 15 spaces but I don't know if

there'll be they're a big organization

I'll have a hard time finding someone

right it we'll prove

it uh but it's not I can say and I did a

walk myself I walked I three blocks in

38:28

every direction around the building and

38:29

I counted uh a significant number of uh

on street parking places at least 10 or

38:36

15 however that was during the day you

know right at night I'm sure you know

people are on and

38:43

what in figuring out the the

38:46

requirements regardless of whether you

38:48

permit them to have vehicles or not I'm

38:49

just looking at what they may be um so

what is it based on bedrooms or yeah bed

BAS units which is bedrooms okay yeah

and there be nine yeah exactly yep okay

we're asking for reduction from nine to

two and because we and we can provide

those two spaces on site that

exis right and and nothing's being other

than the number of people that would

increase I mean nothing else is being

changed right I mean there was nine

bedrooms there is nine bedrooms that's

exactly there could be some minor

changes inside but nothing stor we

change uh like if we move some people

around the move officers around you know

there might be room that's now officed

that the turn to a bedroom then we got

to figure out where they're going to be

so there could be some minor changes

inside but nothing significant there

wouldn't be more than nine bedrooms yeah

there not more than nine bedrooms we're

not creating any more bedrooms right

so just for my clarity so you said it's

nine the request is for 12 but it's for

nine request is not for 12 um it's the

it's yeah so under the way the code's

written now the only limitation on the

40:13

number of residents is based on the

40:16

square footage of the rooms so 50 square

feet per resident room which is less in

40:21

the state basically the the oy

40:24

requirements of the city code code

40:28

limmit the number of people that are

40:29

permitted um under the prior

40:33

ordinance basically it said the

40:35

definition of a family is no more than

40:38

eight unrelated people living together

40:40

as a unit so that's how the eight

40:43

resident limitation was put in place um

40:46

because this was a semi compliant use I

40:49

would say back in 1996 98 um so that's

40:53

where the the limit on the current use

40:56

or up until the new zoning code was

40:59

passed uh now a limitation on the number

41:02

based on building the 12 is bit of red

41:06

herring that is a remnant of a prior

41:18

clarifying that um just curious this was

somewhat mentioned but so the space that

what is this the space being used for

now what what

um I guess would be involved in terms of

any changes that would be required for

that space to be Chang there may

historically or should be bedrooms that

we have offices in now so those people

would move into other areas of the

41:52

building um we haven't finished uh the

41:56

used to be a garage now inish

space we may put some options in there

so that those potato free up

in been conducted for quite some time

and um the so the building itself is

laid out um to kind of have large

Gathering spaces some office spaces very

similar to uh what you would see for a

church so the proposal itself uh to

convert the internal space into a place

of worship use um you know makes sense

from that perspective uh the types of

1:03:28

uses um as far as the impacts on the

1:03:31

community are are fairly similar um you

1:03:33

know much as you'd have a once a week

1:03:36

you know uh consistent um uh attendance

1:03:41

uh on Sundays for this um but they would

1:03:43

have uh uh office hours during the week

1:03:47

um so the property will be open um you

1:03:49

know kind of all week long very similar

1:03:51

to kind of what was previously operating

on site um and the the uh property

1:03:57

itself has uh 43 off street parking

spaces and two lots um to the north and

south of the building uh the based on

the number of um potential congregants

and seats that they would have uh they

zoning code um the applicants had noted

that it's you know probably rare that

that's going to be the case maybe on

some um uh more attended services like

Mother's Day or Easter or Christmas um

so it's probably very infrequent if any

that they would need to use that um and

1:04:53

otherwise uh the proposed use uh is in

conformance you know with the zoning

1:04:58

code um and uh the um site itself seems

to um you know be well accommodating for

a use of this type uh with all that

being said the planning uh commission

recommended that the zoning hearing

board approved the request with the

following conditions uh the applicant

should consider installing a pedestrian

walkway and separate gate so that

parishioners and other visitors can

access the building separately from the

vehicular entrances uh right now there's

no like pathway or sidewalk connection

anybody walking into the site which is

fully enclosed by a fence walks through

a driveway area um the applicant should

install the proposed bike parking near

the main entrance and if possible ensure

that it is sheltered uh and finally the

planning Bureau recommends that the

applicant install landscape screening

along the exterior boundaries of the

parking lots on site to bring the prop

to bring the property into conformance

with the current zoning regulations and

to prevent headlight spill over onto

adjacent Residential Properties um there

is no current landscape screening um

that the current zoning codee requires

um that's a legal non-conforming aspect

considering renovating our current space

it's about 36,000 square feet um before

the pandemic we were averaging about

175 160 people between that range for

Sunday service um during the pandemic we

uh brought up a live stream so people

can live stream our services and then

1:08:03

once things open up after the pandemic

we recognized that uh not all of our

1:08:08

congregates were coming back to inperson

attendance so right now we averag

probably around 110 115 uh inperson

attendance and about 50 people who live

1:08:18

stream so because of that uh we felt

1:08:21

like it was more prudent um to get a

1:08:23

smaller space and and um so we got a

1:08:26

real estate agent and we were able to

1:08:28

come across the 350 Mill Avenue building

um which is about uh 15,000 16,000

Square ft um and it perfectly suits the

1:08:37

size of our congregation so instead of

1:08:40

renovating a 36,000 foot space we

1:08:42

decided to uh it was more prudent to use

uh the ties and offerings of the members

to renovate a much smaller space uh

1:08:50

which uh with much uh lower utility

1:08:52

costs and thingss of that nature it's

1:08:55

just a better all around better fit for

reached out to the school just to kind

of cover all the bases but uh you know

our congre our congregation size will
