access improvements and four Town Homes

two along Logan Street and two along

18:43

Clinton Street uh per the development

18:45

map in the case report the planning

Bureau staff recommends that the case

that the uh application be approved with

18:54

the following conditions uh the

18:56

applicants will redesign aspects of the

18:57

project which were changed subsequent to

18:59

the zoning hearing board approval

including the configuration location of

19:02

buildings 5 through 7 and the Logan

19:04

Street Town Homes uh or will submit uh

19:07

resubmit new zoning relief applications

19:08

for such changes and receive approval

19:10

from the zhp uh those were based on some

19:12

preliminary drawings that were received

by the planning Bureau um in the uh

19:16

interim uh the applicants have provided

19:19

updated documentation on um some of

19:22

those issues uh including the removal of

19:24

a floor at Building 7 uh such that um uh

19:28

much l zoning relief is necessary uh if

19:30

the applicants want to move forward with

19:32

the uh uh project as proposed uh the

19:35

applicants will redesign the Logan

19:36

Street town homes so that the property

19:38

at 1640 nor4 Street can be utilized as a

19:40

public amend amenity incorporating a

19:42

relocated community garden which the

19:44

applicants agreed to during the review

19:46

of phase one of the Capital Heights

19:47

project which included the removal of

19:49

the community garden on North Third

19:51

Street uh the applicants should design

19:53

all the proposed residential units

19:54

within the project to be at least

19:56

visitable if not fully a Ada access ible

19:59

including aspects such as zero step

20:01

entries for the proposed Town Homes to

20:03

ensure the units are accessible to as

20:05

much of the population as possible uh

20:08

the applicant should ensure that the new

20:09

vehicular access point on Clinton Street

uh features a driveway curb cut design

20:14

as opposed to the current Street curb

20:16

cut design uh the applicants will

20:18

coordinate with the city Engineers

20:20

office on new or reconstructed sidewalks

and pedestrian markings such as

crosswalks uh the plan Bureau recommends

that the applicants consider sidewalks

full width of the public right away

Along Hamilton Street and North Fourth

Street specifically and uh the

applicants will should should consider

the inclusion of secure ground floor

bike storage in the proposed apartment

and mixed use buildings and will include

20:42

bicycle racks near the entrance of the

20:44

commercial spaces and buildings uh 2 3

and four as required per section 7-

327.5 of the zoning code the plan bureo

would recommend that such parking be

20:54

located near the main entrance and

20:55

sheltered if possible uh the applicants

20:57

will provide formal landscaping and

20:59

photometric plans to inform discussions

with the City Arborist and to confirm

21:02

consistency with the applicable

21:04

regulations of the zoning code such as

21:05

the fence regulations and the

21:07

environmental performance standards the

21:09

applicants should consider using native

21:10

tree species and pollinator plants and

21:13

finally the applicants will coordinate

21:14

with the Department of Public Works to

21:15

confirm the appropriate size location

21:17

and design of refu collection

21:19

particularly for the multif family

21:21

dwellings and mixed use buildings plan

21:24

Bureau staff recommends the request be

21:25

approved for the following reasons the

21:27

applicants have received approval from

21:29

the zoning hearing board where the

21:30

various relief requests needed to

21:32

effectuate the project as previously

21:33

submitted and if the bureau's conditions

21:35

are adopted will have met the conditions

21:37

of those approvals in the subsequent lot

21:39

consolidation and Land Development

21:40

submission uh the project will enhance

21:42

the character of the neighborhood by

21:44

replacing vacant Lots with buildings

21:45

that reflect the height massing and

21:47

configuration of the surrounding

21:48

community and will enhance pedestrian

21:50

infrastructure throughout the project

21:51

area the proposed residential uses both

21:54

the town homes and the apartment

21:55

buildings will feature two bedroom units

21:57

which are inard which are in higher

21:59

demand than some of the studio or

22:01

one-bedroom developments that have been

22:03

more commonplace in recent proposals and

22:05

finally The Proposal will add new

22:07

residents to the neighborhood and

22:08

activate the street and surrounding

22:09

community on nights and weekends and

22:11

contribute to a growing customer base to

22:13

support local businesses okay thank you

conditions um so uh thank you Mr

chairman by the way um I I don't know if

if uh this board because you've seen

this project on many many occasions

would like a presentation on uh the

22:53

project discussion around uh the

22:56

buildings and uses and Cly Mr can do

22:59

that and then we can talk about the

23:01

conditions look we can make things easy

23:03

mean we'll accept the conditions except

23:07

one we'd like to talk about with the

23:08

Planning Commission and and I leared

23:11

Jeff to some concerns um and we like his

23:15

input as well too so would you like a

23:17

little presentation for us to talk about

23:19

the project do that or we can talk about

23:21

the conditions I say since even though

23:24

we have reviewed it many times but we

23:27

these specific uh project yes we would

23:31

like a quick review okay and we do have

23:33

amended plans if you'd like me to pass

those

23:39

out are those different

23:42

from there are some minor um uh changes

23:45

in the plans with respect to like I said

23:47

U building seven in the original plan

23:49

set was four stories and 16 units this

23:51

one shows 12 sto or 12 units and three

23:53

stories um and a few other changes here

23:56

and there um with respect to some of the

23:59

building Footprints but for the most

24:00

part they're pretty similar I don't

24:02

think there's any um substantive changes

24:05

between the

24:18

two oh and uh two more uh one more

24:20

change I should note is buildings three

24:22

and four on those new sets do show the

24:25

first floor commercial space which the

24:27

prior set did not

24:29

um they just showed it as being sixun

24:31

apartment buildings but they still do

24:33

have the first floor commercial

24:43

space a quick walk through on the

24:46

project is these are the vacant lots and

24:48

Capital Heights every one of these is

24:50

the vacant lot that's been vacant for

24:52

sometime um and part of developments

24:55

that were started failed started stopped

24:58

failed uh repeat over and over about

25:01

four more times these are all infill uh

25:04

three buildings are uh very much

25:08

infill uh spaces that hit Corner Lots um

25:12

that are approximately 30 to 50 ft wide

25:16

uh they feature first floor commercial

25:18

space with a few apartments above each

25:21

uh there's adjacent parking uh to each

25:24

building um and then there are three

25:27

larger 12 unit buildings uh that span

25:31

across bigger lots that are about 200

25:33

feet long and about 100 feet wide and

25:36

then there's one 8 unit apartment

25:38

building uh that sits on a about 100

25:42

about 100 foot wide and Watt by about 70

25:45

ft deep um

25:49

the ldps that you have in front of you

25:52

um reflect the zoning that was approved

25:56

previously in the layout that were

25:58

approved previously with one note on our

26:02

zoning plans the language that was

26:06

listed was to match existing prevailing

26:09

setback on

26:11

buildings 5 six and seven or de and

26:15

app when we received the paperwork from

26:18

the solicitor uh the zoning hearing

26:20

board solicitor with the order there was

26:22

a note after the order on page 22 that

26:26

said instead prevailing to match

26:29

existing prevailing setback it noted to

26:32

move them to the front yard line this is

26:35

the only condition we have an issue with

26:38

because if you're on these Lots Folton

26:40

Street is very so every one of these

26:43

would be pushing against fton street

26:46

it's very narrow it's only about 14 feet

26:49

the total right away is 20 feet so it

26:52

gives you 2 6 in sidewall which isn't

26:56

legal to begin with we'd have to have

26:58

minimum 3T so we'd already be

27:00

encroaching 6 in onto the land to make a

27:03

legal sidewalk which is the intent what

27:06

we'd like to do is move the buildings

27:08

back about four or five feet because

27:10

you're going to have 15 135t long

27:14

building 3 feet off the road on a 14t

27:17

wide Road that's our concern is you'd

27:20

have a very

27:22

narrow lock a road way with a large

27:26

building directly adjacent to it and

27:29

then our original plan should prevailing

27:32

the prevailing block the only uh

27:36

instance of this is the existing town

27:38

homes on fton street and they sit back

27:41

about 6 feet and that was our original

27:43

intent is to sit back about six feet so

27:46

you're not crowding this big building

27:47

right against the road and there's ample

27:49

room on the other side to still maintain

27:51

plenty of Green Space facing roads alley

27:54

and uh Meer alley

28:00

um well I mean as to the zoning hearing

28:03

board's decision it is as written and if

28:05

it was not challenged by the applicants

28:07

that's what the zoning hearing board

28:08

decision is and so that's kind of what

28:10

the applicants need to conform to now

28:12

their point about the narrow sidewalks I

28:15

think is accurate if you go out there

28:17

they're almost certainly not um you know

28:21

compliant with the city standards I'm

28:22

kind of confused as to why they were

28:24

built that way in the first place um but

28:27

if the applic intention is to you know

28:30

provide a wider uh sidewalk um for the

28:34

general public in front of their

28:35

buildings we think that's a reasonable

28:38

um uh justification for um some

28:41

deviation uh for that uh but if it's

28:45

just to put a six yard a six foot wide

28:47

yard in the front you know as we noted

28:50

during the zoning hearing board uh

28:51

reviews and the Planning Commission

28:53

review of the zoning relief requests um

28:55

you know a lot of times these little

28:56

interstitial spaces

28:58

become useless spaces they become they

29:01

get walked on they just become dirt

29:02

patches and they're really not

29:04

contributing either to the streetcape or

29:06

to the benefit of the tenants of these

29:08

buildings whereas if buildings are moved

29:10

to the front property line you create

29:12

more space behind where they can have I

29:14

know patios you know fire pit cornhole

29:17

whatever a place to go out and uh um you

29:20

know maybe walk your do dog or something

29:22

um so in the interest of you know having

29:25

a more useful uh property I think and

29:29

something that I think does better

29:30

conform to the overall uh neighborhood

29:33

and they're right that the one row of

29:36

buildings across the street uh from site

29:39

five uh with the town homes is set back

29:42

and frankly I think going out there kind

29:43

of proves my point is that some of them

29:45

are overgrown with lots and it's because

29:47

they those spaces have no utility um and

29:50

so I think it would give the overall

29:52

project more utility the overall project

29:54

sites more utility to have them as close

29:56

to the front property line as possible

29:58

again if it if the intention is to the

30:00

applicant's point to try and provide a

30:03

more ADA Compliant path along the front

30:05

edges of these buildings that that I

30:08

think is a good justification um but if

30:10

it's just to have a couple of bushes

30:12

that are going to die out in a year and

30:13

a half or something I I don't think that

30:16

um that's frankly good Urban Design or

30:18

would be would make the projects look

30:24

better just on we would be perfectly

30:27

accept making a majority of it sidewalk

30:31

but we' also like to still have some

30:33

type of vegetation trees if you walk

30:35

around the block if you're walking up

30:37

Hamilton or you're walking up Harris you

30:39

have tree planters every 15 to 20 feet

30:42

that's the type aesthetic we'd like to

30:44

keep and we you know most of all we

30:46

would like to keep the building back so

30:47

it's not crowding the street and you're

30:49

not walking down you're not right

30:50

against someone's bedroom you're not

30:52

right up against the building um so we

30:55

definitely are not opposed to making it

30:57

a majority sidewalk with the ability to

31:01

have tree planers say every

31:07

um quick

question Jeff yeah if if if that would

occur I believe that would be consistent

31:20

with the zoning code right we wouldn't

31:22

be in violation of The Zing code with

31:24

that six foot setback and with addition

31:28

I think the devil's in the details on

that we really have to see exactly what

31:32

that looks like I would not feel

31:33

comfortable giving a response without

31:36

seeing you know something written with

31:39

Dimensions well but if if the cach wrote

31:41

five foot or match existing prevailing

31:44

set back which that would do if we say

31:47

they're five foot then we're matching

31:48

the Z directly the point being the zon

31:53

hearing board rendered a decision with

31:54

their decision written out and so the

31:57

project needs to conform to that and

31:59

this was kind of the planning bureau's

32:00

intent from the get-go last year when we

32:03

were reviewing this project is not is

32:05

again not to have these small little you

32:07

know 3 foot x 3 foot front yards or

32:09

whatever it's to have a building that is

32:11

reflective of buildings literally

32:13

throughout the city um I don't

32:15

understand frankly the concern about

32:17

crowding the sidewalk when you

32:20

know blocks throughout Midtown Uptown

32:23

Allison Hill have buildings constructed

32:25

right to the sidewalk it is what kind of

32:28

defines Urban um streetscapes and urban

32:31

spaces is to have this um is to have

32:34

buildings fronting these uh uh the

32:36

sidewalk and directly accessible um to

32:39

the public right away yeah my

32:42

understanding of the concern though for

32:43

the developers Jeff really is the the

32:46

size of the sidewalk of area so um can

32:50

we reach a an agreement that expanding

32:53

the sidewalk would be good for Ada

32:55

purposes um to create some additional

32:58

space on the sidewalk for people to move

33:01

uh like I said I think then widening the

33:04

sidewalks to make them you know five

33:06

foot wide or whatever however large uh

33:08

wide they end up would be a reasonable

33:11

justification for that but um otherwise

33:14

I would probably say no okay so if if if

33:17

we if

33:19

we agree to expanding the sidewalk and

33:23

subject

33:25

to sta planning staff review prior to

33:28

the submission and following the plans

33:30

would that be an acceptable condition

33:33

that's up to the Planning

33:36

Commission if it's for the expansion of

33:39

the sidewalk that would be a

33:40

justification in my

33:44

opinion I'm going to um go to the

33:48

Commissioners I have no question at this

33:52

time and I'll start with commissioner

33:54

old yeah I know at this time right

33:58

commission

re these units are mixed income units

yes uh the whole overall project has U I

34:09

believe about 14% low income set

34:12

aside and the town homes those will be

34:15

those those four town homes in this

34:18

packet are low it doesn't too

uh thank you yep I'll start with an easy

question what's the uh project timeline

34:36

that we're looking

at within a year um and again I always

34:43

CAU saying this because as Chris and I

can tell you right now we are still

these are all H um we just got for the

34:53

project you heard almost two years ago

34:55

to the day uh our plans are sitting

34:58

with the codes Bureau and they're also

35:01

sitting with h waiting for some

35:03

revisions to the contract language and

35:06

after 17 months we receive new parcel

35:10

ideas So within a year is the ideal

35:14

time to break ground or complete ground

35:18

break okay all

35:24

right um so going back to the

35:28

conversation about you know the the

35:31

frontage of the buildings on Fulton

35:34

Street and setbacks or being right up

35:37

against

35:39

all do you know Matt what the WID is of

35:45

the proposed sidewalk presently is it

35:48

like a foot less than a foot the

35:51

addition I can't see a diens if you

35:53

follow what's there now uh they're two

35:57

feet 6 wide they're not even up to code

so if you look at our plans you see

36:02

about 6 in on there that's to get them

36:05

to Legal width right there I mean these

36:07

are they weren't built to code yeah and

36:10

they weren't built like anything else in

36:11

the city you don't have anywhere that

36:12

you have a two foot6 wide sidewalk and

36:15

the RightWay is 20 feet you got a 14

foot wide road so right so the side that

36:20

bit of sidewalks in the has to be in the

36:23

right of way of the road because it's so

36:26

yeah so that's not even ADA Compliant

correct at the current Dimension

no but

36:34

yet one of the conditions is asking for

36:38

Ada comp ADA compliance and visibility

36:41

at the highest extent possible so we're

36:43

sort

of sort of like double like like it's a

36:49

little bit hypocritic we're kind of

36:50

going double-edged sword here asking for

36:53

one condition but then not really

36:54

allowing for the other condition to be

36:56

fulfilled it's a little contradictory of

36:58

what we really want here yeah and and

like I said I agree that widening the

37:03

sidewalks is a is a reasonable

37:05

justification I would just like if if it

37:07

was just to have the setback with a yard

37:10

in front for example I would think that

37:13

that would not be you know a reasonable

37:14

justification right um yeah I mean I'm

37:17

thinking about the ADA compliance

37:20

accessibility the desire to allow for a

37:24

greater visitability of access of the

37:27

sites also the vision zero City plan of

37:31

pedestrian priority and

37:33

safety um so so that's sort of some

37:37

things I'm thinking about I going back

37:39

in then the planner thought

37:43

um would it be a possibility and a

37:46

consideration to sit down with Claire at

37:50

crw to

37:52

discuss um incorporating some of those

37:55

tree Wells and

37:57

uh the smaller storm like rain basing

38:01

you know rain capture areas you could

38:03

incorporate some of those if you went to

38:05

a six foot plus sidewalk with um it also

38:10

might help with some of your storm water

38:12

management

38:13

requirements on the

38:18

sites some food for thought

38:21

for is the condition

38:23

one all focused around this chain

38:28

that

38:29

was there other the condition one was a

38:32

little vague to me and that might just

38:33

be because I don't remember right the

38:36

back and forth well like I said it was

38:38

uh related to like the Logan Street Town

38:40

Homes were set back um and those in the

38:44

initial design and Zoning review were

38:46

set against the front yard there was the

38:47

additional building on um additional

38:50

floor on building seven uh and some of

38:52

these have been corrected in the um

38:55

revised plans but uh additionally when

38:58

the zoning her board does render a

38:59

decision if a plan is designed to not be

39:03

in conformance with those um conditions

39:05

of approval they uh the applicants have

39:07

to go back before this actually happened

39:10

it doesn't happen often uh but it did

39:12

actually happen with the molder Square

39:14

project where they moved some of the

39:15

units from one of the sites into another

39:17

building and the applicants had to go

39:19

back to the zoning hearing board and get

39:20

relief from the condition the zoning

39:22

hearing board applied in that situation

39:24

so that's why we want to make sure that

39:26

the project is going forward in

39:28

conformance with the zoning hearing

39:29

board decision sure understood that

39:32

makes sense

39:34

um my last question is around condition

39:39

two what is the intent of the planning

39:43

Bureau about redesigning that so that

39:46

it's utilized as a public

39:48

amenity so that was as as noted in the

39:51

condition there that was brought up uh

39:53

during the discussion on uh phase one uh

39:56

which was um the block along between

39:58

Third Street and Logan Street and if the

40:01

Commissioners may remember there was a

40:03

bit of a consternation uh from some

40:05

members of the public about the loss of

40:07

the community garden there along Third

40:08

Street and uh I mean you might not

40:11

remember that it was a while ago and I

40:12

think the garden itself has fallen into

40:14

some disrepair since then probably due

40:16

to the kind of Uncertain nature of where

40:18

everything stood there but um as a um uh

40:23

as a offset uh the applicants um had

40:26

noted and I believe it actually ended up

40:28

in some sketch site plan uh that they

40:31

would be having the community garden on

40:33

the Block to the east in fact I looked

40:35

it up uh while doing this case report

40:37

and I believe commissioner Merck you had

40:39

asked about that and they had said you

40:41

know we will provide this Garden um to

40:44

the East and I believe it was meant to

40:45

be a continuation of a brick sidewalk

40:47

that went through the uh block of phase

40:50

one and then through this site through

40:52

this uh block here alongside the Logan

40:55

Street town homs

40:57

if I can real quick on that um the size

41:01

of the town homes have been increased a

41:02

little bit which page are you on so

41:07

you so the community garden is still

going to be there um and we will update

the plans to show access to it but it

41:22

will be at the the where you see site

what we'll do uh before submission and

Bureau is we'll throw a hatch pattern on

there and show this area is dedicated to

41:39

community garden if you look directly

above that there's actually an existing

RightWay there uh and there's a pathway

you you'll see it even indicated uh to

41:48

your left there's an existing walkway

41:50

there that buts the property so still

41:52

have a RightWay access um and then we

41:55

will show the portion beyond the

41:58

townhouse lot as dedicated to communal

42:01

space community garden space so there'll

42:04

still be access um we might put a note

42:06

on there that the portion of

42:11

access

42:12

within our land will be updated and

42:16

upgraded for easier ease of

42:21

access what's that yeah if well if the

42:25

intention is to expand that over to

42:27

North Fourth Street so that it's

42:29

accessible to the public and visible to

42:30

the public I think maybe that'd be okay

42:33

but to just put a little island in the

42:35

center of the of the block that's really

42:37

only accessible via the parking lot and

42:40

bya a maybe 4 foot wide uh Grocers alley

42:44

that runs behind buildings like that to

42:45

me does not say welcome Community it

42:47

does not say this is a community space

42:49

it says you know this is a space that's

42:52

really off limits to people and um you

42:55

know I don't think that was the

42:58

intention uh of the planning Bureau to

43:02

accept what they're proposing now um

43:05

when we discussed this a year ago uh and

43:08

you

43:09

know the I'm not sure why the townhouse

43:12

is just had to be widened all of a

43:14

sudden the ones along um uh Clinton

43:17

Street seem to be about the same size as

43:20

the lots that are along Logan Street

43:22

they've just widened the houses uh and

43:25

again post discussion of this with the

43:29

Commissioners and with you know planning

43:31

Bureau staff and uh you

43:35

know I I just think the applicant should

43:38

be following through on the commitments

43:39

they've made in previous discussions of

43:41

this project and phase one of the

43:44

project um again maybe it doesn't have

43:47

to look quite the same as using the

43:49

whole block or the whole property at

43:51

1640 North 4th Street for public right

43:54

away but you know that was definitely

43:56

the

43:57

uh discussion point at the last meeting

44:00

and um to change that then after the

44:02

fact after getting approvals is you know

44:06

not something that I think is a good

44:08

look um when we're changing the design

44:11

to something that was previously agreed

44:13

upon the applicant has no issue

44:15

dedicating four four feet space to the

44:19

north to wider access

44:29

which would match the

44:49

original well I can't Jim in about that

44:52

commentary it's between those

44:55

two we no toic it was 4T back so it

would be an 8ft

wide um so you have 7 ft right now

between the two but given up the three

45:08

foot set

back think the constract ability on it

this one the house doesn't actually

encroach the whole way so we have room
