just a few comments before we begin our

topic for tonight's policy work session

is Ghost guns um you may have seen a

1:38

little preview on the news the other day

1:41

um but it is something that was

1:43

discussed during our last um quarterly

1:47

report for the first quarter of 2024

from the Bureau of police they noted uh

1:53

the number of ghost guns that had been

1:56

seized to this point um before We Begin

our presentation I wanted to uh see if

2:04

our Public Safety chair councilman Jones

2:07

had anything he wanted to say before we

2:09

begin uh thank you president bers um

2:11

just basically to um your your points um

2:15

you know we've seen uh a lot of ghost

2:18

guns being

2:19

confiscated um in the city of Harrisburg

2:22

over a course over a period of time by

2:23

the Harrisburg Police Department and um

2:26

this is a growing issue in a lot of uh

2:29

community ities around uh Pennsylvania

2:32

you know so I think this is something

2:34

that we we can get in front of and uh

2:37

build out an ordinance for it if

2:38

possible and um reached out to Mr flood

2:42

cease fire to uh give us a little

2:44

presentation on some of this so all

2:47

righty okay thank you we're joined by Mr

members for your Indulgence uh anyone

from the community too thank you for

your interest um you know before so what

I'm going to do is I'm going to kind of

lay the table this will be as formal as

3:11

I'll be and then after that we can kind

3:13

of informally do a Q&A um but before I I

3:17

begin my remarks I want to say that I am

3:19

a gun owner um so I'm certainly very

3:22

mindful even though I work for an

3:25

organization that advocates for gun

3:27

violence prevention we also are in the

3:28

business of advocating for responsible

3:30

gun ownership so at least wanted to set

3:32

the table that this is this is this

3:35

policy isn't and certainly I don't

3:36

represent myself as a gun Grabber we're

3:39

about responsible gun ownership

3:41

particularly in Harrisburg city um that

3:43

being said um the issue of ghost guns

3:46

making their uh way into the hands of

3:48

criminals is a growing problem in our

3:51

cities and for our law enforcement

3:52

officials Statewide or na Nationwide

3:54

rather uh to illustrate how Insidious

3:57

this issue is law enforcement a gencies

4:00

nationally now this is give some context

4:02

in 2016 2016 alone there were

4:07

1,758 ghost guns that were recovered

4:09

nationally by the ATF now that's 2016 uh

4:13

between the period of 2016 to 2021 we

4:16

seen that number Sky Skyrocket to close

4:18

to 50,000 ghost guns that are recovered

4:22

and again these are recovery rates that

4:23

doesn't account for how many are

4:24

actually in circulation and have not yet

4:26

been recovered um as Council councilman

4:30

Jones alluded to he talked about uh the

4:32

unique issue or might have been council

4:35

president uh Bowers who talked about the

4:37

news uh CBS 21 did a probably was ABC 21

4:41

abc27 but 21 did a brief uh feature

4:44

about Central P about how it's impacting

4:48

uh Central PA York Harrisburg Lancaster

4:52

uh and in that report they mention that

4:54

the city of Harrisburg since 2020

4:56

recovered 51 ghost guns again recovery

4:59

doesn't mean you know how many doesn't

represent how many are actually in

5:02

circulation so it's this kind of

5:04

phenomena this isn't just unique to the

5:06

city of Harrisburg this has happened in

5:09

nationally in fact it was this

5:11

phenomenon that prompted the Biden

5:13

Administration and the Bureau of Alcohol

5:14

Tobacco firearms and explosives to issue

5:17

a final rule in April of 2022 that

5:20

Define ghost gun kits as Firearms under

5:22

the law so that government could be more

5:25

uh so that government could more

5:27

carefully regulate them by ensuring

5:29

proper Market marking record keeping and

5:31

traceability uh for those of you who may

5:33

not be familiar with ghost guns and and

5:35

you'll hear this term used

5:36

interchangeably the the real policy is

5:39

unfinished firearm build kits right so

5:42

these are kits that come I like to

5:44

describe them as a the Ikea of guns you

5:47

know you you purchase these uh pieces

5:49

that are unassembled and it allows the

5:52

the user uh you know especially least

5:55

80% kits you have a partially complete

5:58

kit for you to assemble and whether you

6:01

you get the remaining parts from a using

6:04

a 3D printer or from some other means

6:06

you're you're able to build a functional

6:08

firearm uh which does not have any uh

6:11

serial numbers and cannot be traced so

6:13

that's why you hear the term ghost guns

6:15

ghost guns I like to say are more so

6:17

used are the ones that are being uh

6:19

crime guns that don't have any

6:21

serialization or markings that are out

6:23

there floating around and aren't you

6:25

know these aren't people that are just

6:26

building guns for themselves right you

6:28

know because that's the one thing to to

6:29

bear in mind too is this policy in no

6:32

way shape and form prevents someone from

6:33

being able to build their own gun um you

6:37

know even if there were a Statewide uh

6:40

initiative doesn't Pro prohibit them

6:42

from doing so you can still do so if you

6:43

can lawfully possess a firearm the the

6:46

difficulty becomes is if you don't have

6:48

a background check for someone who's

6:50

buying these pieces you can't ascertain

6:51

whether or not they are law for or not

6:54

so that's the the that's what this

6:56

initiative certainly is looking to

6:58

address so you know as I told you you

know the rule that was issued in 2022 by

7:04

uh the Biden Administration know while

7:06

that was a a certainly a great first

7:08

step forward um there weren't any

7:11

additional resources allocated to uh

7:13

federal law enforcement to enforce these

7:15

rules right so we can make all the laws

7:17

and rules and regulations we want all

7:19

day long but if we don't have the

7:21

infrastructure or the uh just the

7:24

capacity to be able to enforce uh these

7:27

these rules um you know they're pretty

7:29

much in effective so that's part of why

7:31

what we're looking at doing is you know

7:33

we watch what happened in the city of

7:34

Philadelphia in 2021 they introduced the

7:36

same ordinance uh they were sued by Gun

7:39

Owners of America ultimately that case

7:42

made it to Commonwealth Court where

7:45

common the Commonwealth Court affirmed

7:47

the legality and constitutionality of

7:49

that ordinance so what we want to do

7:51

here is be able to equip our local

7:54

officials with the ability to address

7:56

these issues I I consider this to be a

7:58

stop Gap measure this isn't something

8:00

that we think you know and we'll see

8:02

that later on down the line but we we we

8:04

also and I talked about that case in

8:05

Philadelphia even though the

8:07

Commonwealth Court affirmed that ruling

8:10

gun owners the The Gun Owners of America

8:13

they appealed that case to the

8:15

Pennsylvania Supreme Court and that's

8:17

where it's currently at uh but that that

8:19

ordinance Still Remains valid in

8:22

Philadelphia as we speak also on the

8:25

national side many of you may have seen

8:26

too uh you heard me talk about that

8:30

those rules that were issued by the

8:32

Biden Administration in in in

8:34

2022 uh that also made it the court and

8:37

currently the United States Supreme

8:39

Court is going to be taking up the issue

8:41

of ghost guns uh hopefully sometime this

8:44

year uh but one of the things to to be

8:47

mindful of is that the Supreme Court

8:49

stayed the the the regulations so those

8:52

regulations that were issued by the bid

8:54

and administration still remain in in

8:56

effect until which time that the Supreme

8:59

Court issues its ruling so I know a lot

of folks are going to talk about and you

9:05

guys as a municipality have experienced

9:07

in the past lawsuits uh I would say in

9:09

this case certainly uh if this ordinance

9:12

were to be enacted I don't foresee any

9:15

challenges uh happening until which time

9:17

that both the PA Supreme Court and the

9:21

United State United States Supreme Court

9:24

issue some guidance on this stuff so you

9:26

know that's part of the reason why we

9:28

are reaching out the municipalities uh

9:31

the the first municipality we reached

9:32

out to was the city of York uh we also

9:36

had that commissioner malro there who

9:37

was also in support of this initiative

9:40

you know uh the city of York and I'm

9:42

sure you know councilman uh Jones uh is

9:45

dealing with the same issues that

9:47

Harrisburg is dis uh dealing with it is

9:49

our intent to go to all of our larger

9:51

metropolitan areas uh and and Advance

9:54

these initiatives so our next our next

9:56

city that's up is going to be Pittsburgh

9:59

um and we're also having some

conversations with Aluna so and in terms

10:04

of what this ordinance does functionally

10:06

so all that all that we're asking as

10:08

body to do uh is to introduce this

10:12

ordinance so that it dictates that

10:13

anyone using a 3D printer for the

10:15

purposes of printing Firearms or firearm

10:18

Parts be required to be a federal

10:20

firearms licensee I did send some

10:23

handouts in advance to uh Jared where

10:26

it's it's a literally a 10 easy 10 step

10:29

process to become a federal firearms

10:31

licensee it's not certainly burdensome

10:34

again me as a gun owner I've had to go

10:36

through the ATF for certain uh for

10:39

certain

10:40

certifications um so you know again it

10:42

may be an inconvenience but it certainly

10:44

um doesn't it doesn't encroach upon

10:47

one's uh uh Second Amendment rights so

that's what this ordinance would do you

know again back to what we talk about

10:53

enforcement one of the questions that

10:55

come up is you know how are you guys

10:56

going to if this is ultimately enacted

here you guys going to enforce this so

there's a you know this is where you

guys can become creative here right

11:03

there's a number of different ways

11:05

obviously the the the first uh method of

11:08

enforcement would be as folks understand

that this is an ordinance in this city

some you know greater self-regulation

11:15

right you know we we know that just

11:17

because you make a law not all folks

11:19

follow the law but there are some folks

11:21

that operate in that gray area right if

11:22

you're not expressly telling me what I

11:24

can't do or I can do we're going to find

that loophole so you know that's you

11:30

know so self-regulation is the first

11:32

piece and then task force too right this

allows you guys to impanel task force

and I was talking to councilman uh

Rodriguez earlier outside whether you're

creating a new task force or you're

11:43

adding a different facet to an existing

11:45

task force right so you guys have the

11:47

parent task force that was recently

11:49

created you heard me talk about that CBS

21 interview that happened they said one

11:54

of the biggest uh targets that law

11:57

enforcement are focused in their energy

11:59

on are young people young people are

accessing these guns CU you can

12:02

literally buy these these these

12:04

unfinished firearm Bill kits online uh

for any of you that have children you

12:09

know that they have access to no credit

12:11

cards my son my 12-year-old has credit

12:13

cards and cash cards and and the like so

you know they said that was the target

12:19

population and if you know and I have

12:21

colleagues that work in the Juvenile

12:22

Justice System where they've had kind of

12:24

these uh feedback sessions and when they

12:27

would ask them where are you guys

12:28

getting these guns from they say can buy

12:30

them online right we people are buying

12:33

them online so these task force will be

12:36

certainly helpful and enforcing and

12:37

being able to focus in on these uh these

12:40

these these type of weapons even if it

12:42

is parents right you know parents being

12:44

more Vigilant in the homes right you see

12:46

these K you might see a part of a gun

12:47

that may resemble a a a toy gun right so

there's there's stuff that can be done

12:51

on the task force side and then

12:53

information campaigns right you know

12:55

whether that's you know I know and of

12:57

and you guys can correct me if I'm wrong

I don't know how

many gun dealers now there might be ffls

in the city that may operate from you

know their basement but how many gun

13:08

actual gun stores you have in Harrisburg

City I don't think there is any that are

there may be on the outside like lower

13:15

packs them and the like so information

campaigns I say that this say is that

13:19

people understand hey this is an

13:21

ordinance again you you help educate

13:23

someone so that they can self-regulate

13:25

um you know so if you are engaging uh

13:28

stores or or folks that operate in that

13:30

way you know one other thing that makes

13:31

Harrisburg very unique is that you guys

13:33

have the farm show which they usually

13:35

have those very big outdoor shows right

13:39

where you have a lot of these well not

13:41

won necessar say I won't necessarily say

13:43

ghost guns but all types of weapons are

13:45

being sold so you know it certainly

13:47

brings a very robust crowd here the farm

13:49

show is situated in the city um so again

13:53

this is very this makes it an an even

13:55

greater incentive uh for the city to

13:58

enact this ordinance and again in a stop

Gap stop Gap matter be able to address

this while we wait for uh the high court

14:05

both on the state and the uh US Supreme

14:08

Court to act on this stuff um and then

14:10

too just see something if you know you

14:12

know just like if you for those you that

14:13

take the train or the uh airplane to see

14:16

something say something campaign same

14:18

type of deal right you know at the you

14:20

know in a perfect world we would love to

14:22

be able to allocate salaries for people

14:24

to be focused on this and enforce this

14:26

but we have to be creative and use the

14:28

resources we have more importantly um

14:31

especially if we're talking about our

14:32

youth engage our parents and and and ask

14:34

them to be accountable to themselves and

14:36

be more vigilent so um I'm going to put

14:39

a pause right there and I will open it

up for any questions uh that anyone may

have okay um thank you Mr flood um this

for me you you answered a lot of the

14:52

questions that I was want to have uh for

you um for the viewers and um some

14:57

people in the audience to actually hear

uh those things but you know uh one of

the things that you said is one of my

15:04

biggest concerns is um our youth you

15:07

know as uh the Commissioners here him

15:10

and I had a conversation earlier um and

15:12

just looking at the numbers of incidents

15:15

with our youth and juveniles and you

15:16

know um and a lot of them are getting

15:19

into this just like you said is easily

15:21

accessible to them um and that would be

15:24

the concern for me and I hope that uh we

15:27

would do a lot of Education I would I

15:29

would intend to do a lot of uh education

15:31

around uh making the parents and the

15:34

community aware of these I'm sure they

15:36

heard of them but um again just looking

15:39

at how easily they are accessed assessed

15:43

by um using um online um we we look them

15:46

up you can get the purchase these kits

15:48

for about 20 bucks um all the way up to

15:51

AR-15s and those those seem to be a

15:54

problem um they wanted to try to I guess

15:56

try to discontinue them or make them um

15:59

not uh to assault rifle cuz right now

they're not considered an assault rifle

16:03

that that's what makes them easily

16:06

accessible so my concern would be for

16:08

the Youth in our community get easily

assessing these things um not being um

16:13

licensed um and and and they're just not

16:16

able to trace them so that's one of my

16:18

biggest concerns and um you you spoke on

16:20

a point of what enforcement would look

16:23

like and I think um we could find a a

16:26

creative way to to um again add some

16:29

Focus again because there are task force

16:31

that our police force already have out

16:33

there they already have gang units and

16:35

things of that nature you know I don't

16:37

know what it would look like to add that

16:39

item to the agenda you know for you guys

16:42

but um that is something that I would

16:44

definitely would be considering to do

16:47

and also just making sure that the

16:49

community is informed as much as

16:51

possible about this so with that it

16:54

seemed like you wanted to respond yeah

yeah so two things number one um now

mention in the the Biden Administration

one of the things that they did probably

17:03

maybe the last three months is they

17:05

reached out to all uh all school

17:08

districts administrators for all school

17:10

districts to teach you know to get them

17:11

to engage the student body and parents

17:14

about the safe storage of firearms right

17:16

you know a lot of parents a lot of kids

17:18

live in homes where uh the parents do

17:21

have firearms that may not be properly

17:23

stored so the same thing can have the

17:25

same kind of dynamic when it comes to

17:27

the ghost guns right engaging even the

17:28

school district and any campaigns that

17:30

they may already have in conjunction of

17:32

what's happening with the the Biden

17:33

Administration and then I also want to

17:35

mention too now I didn't necessarily go

17:37

into um the Commonwealth Court the the

17:40

rationale for the Commonwealth Court's

17:42

uh reasoning for affirming uh the city

17:45

of Philadelphia's ordinance so in

17:47

Pennsylvania they have what's known as a

17:48

Statewide preemption statute that

17:51

dictates uh that dictates how Firearms

17:54

the possession of firearms even

17:56

ammunition are regulated essentially

17:58

says that the state is to be the the the

18:02

entity that dictates the regulation

18:04

thereof so doesn't allow municipalities

18:07

to do so so you guys have seen in the

18:08

past with I think the public discharge

18:11

ordinance in the past same thing with

18:12

York um but what what's unique in this

18:15

case is that these kits are these these

18:17

these guns are un they're disassembled

18:20

right so they're they're not they're not

18:22

a complete firearm so because they are

18:24

in Parts they do not constitute a gun

18:27

and thus aren't subject to that state

18:29

preemption statute so that's that was

18:31

kind of the workaround for that that uh

18:34

ordinance and from what I'm told from

18:35

the uh the attorneys from Philadelphia

18:38

uh that was you know that was deliberate

18:40

you know and them in and and advancing

18:43

this ordinance so you know know this

18:45

opens the door for cities um if in the

18:48

past you could do anything about uh any

18:50

Firearms this gives you gives localities

18:53

more agency uh to be able to do

18:55

something again in a stop Gap measure in

18:58

a stop Gap way until it's time that

either the Pennsylvania General Assembly

does something broadly on this or until

19:05

we see what the US Supreme Court

19:07

dictates so one of the things that you

19:10

mentioned too um with this ordinance out

of Philadelphia being them being a first

19:14

class city um and you said that we we we

19:17

would have freedom so is that just

19:19

working with our solicitor and and and

19:22

making sure that is formulated the right

19:23

that um that we can I guess uh uh

19:28

formulate it into a third class city

19:32

ordinance yeah I'm going to start with I

19:34

don't know the answer to that um it and

19:37

it's we have to find a way to make it

19:38

fall into the enumerated powers um

19:41

Philly will be a very good example they

19:43

they have a different structure than us

19:44

and they have more constitutional

19:46

freedoms than third class cities do um

19:50

and but it's going to take a little bit

19:51

of

19:52

thought whether we're you know what is

19:55

the enforcement mechanism because that's

19:56

really the challenging part is is it

19:59

possession of a ghost gun is a

20:02

possession of a 3D printer is it the

20:04

printing of a program that isn't a like

20:06

what those things are going to take a

20:07

little bit of thought what is it you're

20:09

trying to nip in the butt exactly and go

20:12

ahead right so so so that's going to

20:14

take a little Nuance to to dig into um I

I I believe the uh issue about

20:21

disassembled Parts is is a helpful one

um I don't know what the us or state

20:27

supreme court is going to do but I think

20:28

both going to make decisions that may or

20:30

may not match up um as far as I'm aware

20:34

there are three other gun matters

20:36

pending in front of the state supreme

20:38

court right now um and our gun case from

20:41

2015 we were back in court yesterday at

20:45

just another motion another argument

20:47

still in the county court it's been up

20:48

and down and up and down um so you know

20:53

I think you have to go into this

20:54

expecting someone will challenge it

20:57

absolutely um there's ways to manage

20:59

that as well on the front end including

when you make it effective right and and

21:04

I had a conversation as well um you know

21:07

again with with our commissioner and one

21:09

of the things that um you know as an

21:12

ordinance if if they grab someone with

21:14

with and then they uh send this over to

21:17

the DJ's office it could be a concern

21:19

that it gets kicked from there so I

21:21

think one of the other steps um for me

21:23

to do is to have a conversation with the

21:25

president judge um and also the district

21:28

attorney you know to make sure that

21:30

we're on the same page if if this

21:32

ordinance is and that can help with some

21:34

of the enforcement in in in my opinion

21:36

and I think the district attorney is

21:38

going to be a

21:39

critical uh person to have involved

21:41

chief law enforcement for the county

21:43

their their view of this is going to

21:45

matter well I I I've already had

21:47

conversations with um district attorney

21:49

Charo and um he was he he said he would

21:52

love to see uh you know some some some

21:55

resolution or ordinance for this you

21:57

know and again um I know a lot of it's

22:00

dependent on what happens in the federal

22:02

on the federal level but um as it stands

22:05

there is it seems to be a way that we

22:07

can put something on the books and again

22:10

like you said um strategically and

22:12

crafting this to fit you know in a way

22:15

and one of the things for me to see is

22:17

again just

22:18

not I I still don't think that it would

22:21

stop them from being able to access but

22:24

long as there's some type of penalty

22:26

behind it you know there already is is

22:28

but you know them being a these young

22:31

kids being able to get these guns we

22:32

need a way to deter them from utilizing

22:36

guns period but especially ghost guns

22:38

they're they're growing concern like you

22:40

said across the the nation yeah I I

22:42

think ghost guns just thinking it

22:44

through the concern is and this is why

22:47

we talked about the manufacturing on a

22:51

printer we're we're not as it sounds

22:54

it's not as much as against the

22:55

possession of it right cor it's against

22:58

stopping the flow of it happening in the

23:00

first place which is the Big Challenge

23:01

and without it being tracked again like

23:03

you said you have we all have a right to

23:05

bear arms if you can legally do so yes

23:08

right right and so but but we're trying

23:10

to get the manufacturers that may or may

23:11

not be in Harrisburg Pennsylvania

23:13

absolutely right that's the absolutely

23:15

so again is that the part of the case

23:17

that happened for the for the eastern

23:18

district where they stopped the sell of

23:20

it for at least four years or something

23:22

well yeah I me I'm glad you meant that

23:24

mention that too so that's another

23:25

enforcement mechanism too you know I

23:27

gave you guys ated a few but what the

23:30

city of Philadelphia did is that they

23:31

actually sued two of the largest now I'm

23:33

not saying that's what Harris P to do

23:35

but you know let you guys decide that

23:37

but um what they did was they sued two

23:39

of the largest ghost gun or ghost gun

23:41

kit makers um in the country polymer 80

23:45

as well as jsd Supply uh what you

23:47

reference is uh polymer 80 they came to

23:51

a mutual agreement with the city uh they

23:53

will no longer be selling any kits this

23:55

is polymer 80 in Philadelphia and

23:58

surrounding uh counties uh for four

years uh and then jsd Supply won't be

24:04

selling products for four years

24:07

um and that's Statewide so you know

24:10

these are things that that's another

24:12

another if you want to look at another

24:14

method of enforcement again it's an

24:16

opportunity to be creative about how to

24:17

do that to to Neil's Point too this

24:20

ordinance would not be uh doesn't would

24:23

not penalize someone for merely

24:25

possessing a 3D printer obviously it's

24:27

the intent of what you or what you do

24:29

with the printer if you know because you

24:31

can make a lot of things with 3D

24:32

printers not just Firearms um so no it

24:36

would so so real fast um Neil this may

24:39

be a question for you so with the with

24:41

the ban of that those sales for that

24:44

elim I mean that amount of time four

24:46

years in the state of Pennsylvania

24:47

correct so they would they would no

24:49

longer ship those things to this area

24:53

right now what New Jersey Maryland them

24:55

sipping mean so my point though my point

so that's what I'm saying I think

something else comes out of that now it

becomes trafficking it comes something

else 80 um their prohibition applies to

25:08

surrounding counties and surrounding

states so your surrounding state but

again it's only it's a finite period

four years four years um and again this

was something that they broker

25:16

themselves again part of just having

25:18

that convers you know maybe not have to

25:20

necessarily lead to litigation but

25:22

having a conversation engaging those

25:24

manufacturers obviously these are the

25:25

two largest there's a lot of Outfitters

25:27

that that that make these uh products

25:29

available or that you can purchase them

25:31

from um and then to the the thing that

25:33

um no had mentioned about an effective

25:36

date right you know one of the things is

25:38

you know obviously in a perfect world we

25:39

want to wait to see what happens on the

25:41

state level or happens on the US you

25:43

know with the Supreme Court uh but you

25:45

know we it's it's a we never know when

25:48

that will happen right so again this

25:49

kind of goes back to what I mentioned

these kits that do they are not

serialized so you know and again you

know to be frank with you and I said the

same thing to York City Council is um

I'm I'm pretty confident that the Senate

will not take up the the Bill did make

it out of the house it's in the Senate

chamber I'm pretty confident that the

will not have have this run so you know

prohibited purchaser at the time of them

to be proactive versus find out after

the fact oh this person was prohibited

incomplete gets around all kinds of laws

is when when the Biden Administration

issued uh those rules on ghost guns in

operate again there's a lot of people

that operate in that gray area and two

purchasing a firearm and I can find a

workaround way that technically is not

legal and I know there's a demand for it

this push back because there's an

industry for it it's not that folks feel

freedom to these guns this is also um an

economic driver too for a lot of these

that's kind of the the the the the issue

certainly know there are people that you

utilizing this technology and giving the

current legal landscape are are able or

Public Safety as a whole right so just

those of you don't know what ghost guns

are so ghost guns so what we're talking

about today are unfinished firearm build

36:03

kits uh which are you know have existed

36:06

for quite some time but what what the

36:08

issue is is that now you have these

36:10

unfinished kits that do not have any

36:13

markings um there's no record keeping or

36:16

there are no serial numbers on these

36:18

kits they and you heard me mentioning

36:20

they're unfinished so they're partially

36:22

built um you don't have to undergo a

36:24

background check you can literally

36:25

purchase it online um

36:28

they don't ask about I mean they might

36:30

ask about age but obviously there may be

36:32

ways they be able to skirt pass that I

36:33

haven't G now I've I've put the ghost

36:36

gun in my cart online with do M but I

36:38

haven't gone all the way through to see

36:40

what exactly um that entails but that's

36:42

what the issue is um and obviously the

36:44

the rampancy of these weapons uh that

36:47

again you know accessibility is key so

36:50

again if you can purchase this it's

36:51

almost like door Dash right if I can get

36:53

door dashed uh 80% of a firearm and able

36:57

to use a 3D printer or some other means

to complete the rest and I I

37:02

knowingly I I knowingly I know that I'm

37:05

a prohibited purchaser that I'm not

37:07

legal it's not legal for me to own or

37:09

possess a firearm um that's the

37:11

workaround right and in the context of

37:13

the city of Philadelphia excuse me in

37:15

the city of Harrisburg at least some of

37:17

the numbers that were the preliminary

37:19

numbers that were provided by Harrisburg

37:21

Police is that I believe since 2020 or

37:24

2021 it's over 50 or 51 ghost guns have

37:27

been recovered in the city again that's

37:29

recovered not doesn't necessarily mean

37:31

how many are actually circulating have

37:33

not yet been recovered so you know for

37:35

us you know obviously you know one of

37:37

the big things we hear from this

37:39

community is you know we try to prevent

37:40

violence as much as we can especially

37:42

gun violence but you know you know it's

37:45

it's it's a tough job to be able to do

37:46

that right so when we hear people talk

37:48

about the the the rate of these unsolved

37:51

homicides right one of one driver of

37:53

that is you know having guns that are

37:55

untraceable that are used in in these

37:58

offenses so you know essentially what

38:00

we're looking to do here is to uh Lobby

38:03

uh Harrisburg city council to Institute

38:05

an ordinance uh to if folks are going to

38:08

be either purchasing or selling these

38:11

weapons that they uh become a federally

38:14

Firearms licy before doing so uh so that

38:17

there is some accountability so we know

38:20

uh the folks that are purchasing these

38:21

items are lawful um and they're to be

38:24

able to possess and use these thank you

38:27

would you mind sharing um some of the

38:29

statistics that were outlined in your

38:32

talking points just so just to further

38:35

frame the issue and the significance

38:37

were not unique uh to this issue uh

38:41

within the Commonwealth yeah um as as

38:44

council president Bowers had just

38:46

mentioned uh Harrisburg is not unique to

38:48

this issue you know we're actually going

38:50

uh municipality well we're starting off

38:52

with some of the larger municipalities

38:53

to do this very same to advance this

38:55

very same initiative we started with

38:57

York uh harrisburg's next and then

38:59

Pittsburgh and Altuna and others you

39:01

know but uh to give some context about

39:04

this about how uh great of an issue this

39:08

is is in 2016 and you know and this is

39:10

something too that that the commissioner

39:12

can attest to too is uh a lot of law

39:15

enforcement agencies weren't even

39:16

capturing information about ghost guns

39:18

prior to 2020 you know so a lot of them

39:21

are just now being a are just now

39:23

tracking those fires but in 2016 there

39:26

were about 18 00 ghost guns nationally

39:30

that were recovered by law enforcement

39:32

um between 2016 and 2021 it was uh over

39:36

45,000 ghost guns have been recovered

39:39

and again this is a recovery rate

39:41

doesn't mean how many they're actually

39:42

in

39:43

circulation um you know the we I talked

39:46

about you heard me talk about York York

39:48

in 2023 they had uh 20 ghost guns that

39:51

were recovered right and we have a

39:52

couple right to know requests for a lot

39:54

of different police departments to to

39:56

get a greater sensus that because even

39:58

when we went to the state police to get

40:00

a number of to get an ideal number of

40:02

how many of these guns were recovered

40:04

they couldn't necessarily give us a

40:06

provide us with an accurate number

40:07

because they said a lot of these law

40:08

enforcement agencies they're not as

40:10

diligent with reporting these these

40:12

numbers right so um they gave us a you

40:15

know same thing with the attorney

40:16

general's off so you have different

40:18

agencies that are seizing these guns so

40:19

this is a a a very um this is a a

40:23

rampant issue and certainly one of the

40:25

things that was mentioned in a a local a

40:28

recent report by CBS 21 was that um you

40:32

know not only is this an issue generally

40:34

but uh it's more pronounced when it

40:36

comes to our youth that are in

40:37

possession of these weapons so know

40:39

that's kind of the target population of

40:41

folks are become and you know and and

40:43

word travels around again you know so

40:45

people know and you have some people

40:47

that just in the business I may not be a

40:49

gun dealer or FFL but I I know that if I

40:52

buy this ghost gun kit for $400 I can

40:55

sell it to Johnny for $600 $ right so

40:58

you have those kind of things happening

uh so this ordinance uh we at least want

41:02

to make a dent uh to to whatever extent

41:05

that we we could in Harrisburg city

who's either selling or buying that is a

so if you're if you're purchasing as a

Harrisburg resident or if you are a a a

dealer presumably FFL or yeah if you're

ideally if you're I mean obviously you

can say people who you heard me use the

example there are people who aren't uh

licensed are selling but in the context

44:28

of a gun dealer that whether they're in

44:31

Harrisburg or outside of it if you're

44:33

selling to a Harrisburg resident yeah I

44:35

mean then that would be that would apply

44:37

but to your point I'm sure your

44:39

follow-up point would be is how would we

44:41

be able to uh ascertain that that online

44:45

sale from a dealer that may not be in

44:48

Harrisburg or in Harrisburg for that

44:50

matter that transaction happening I mean

that's the difficult part where I said

you have to kind of be uh a little

cretive creative even if especially for

44:58

talking about young people even if it's

44:59

looking at your monthly statements right

and seeing what things are coming off um

you know and obviously you know some of

those transactions don't necessarily are

very clear in what exactly was purchased

so uh but yeah that that's how the

scenario would work so um can you

explain the differences in the

requirements from a Pennsylvania license

and a federal license yeah so

Pennsylvania license you're probably

talking about what's known as a

concealed carry permit

um that so that's distinct from the

federal so this with essentially if you

are FFL a federally firearms license e

you would be able to operate as a dealer

so you have some folks like your um what

is that Cabellas or what what is the one

out there with the East Mall Bass Pro so

you have your big folks like Bass Pro

but you also have folks that are they

45:47

call them uh what do they call them uh

kitchen table uh ffls right where you

have folks that are licensed to sell

45:56

firearms but are doing it out of the a

45:58

residential residence right or maybe in

the basement of their mom's house doing

46:01

so so the distinction between becoming

an

FFL and what you're talking about would

46:08

be um your ability to carry a firearm uh

46:11

in a concealed Manner and Pennsylvania

46:13

so that would be the distinction so

someone with an FFL license they can

46:18

also sell not just correct not just to

46:20

carry corre yes okay okay and then

46:25

um so could someone not have a

46:29

Pennsylvania license but get the FFL

46:32

license just for the sake of bypassing

Pennsylvania rules what was the first

part you said so if

someone yeah re oh so like could someone

in Pennsylvania who would want to own a

46:48

gun but let's say they there's some

46:50

reason they can't get one in a

46:52

Pennsylvania license would they be able

to get the FFL license

no I mean if you can't get a concealed

carry permit you're not going to be able

to get the FFL um and the FFL would be

47:03

I'm sure a higher standard then

47:06

currently if you're getting a concealed

47:07

carry permit you just go to the

47:09

Sheriff's Office the sheriff sends it to

47:11

the state police the pic check um and

47:14

and they usually tell you pretty quickly

47:17

um you know depending upon the volume of

47:19

requests whereas with uh um but a

47:22

federal firearms licensing you're

47:23

dealing with there's a lot of other

47:25

barriers and and a lot of other uh a

47:29

greater degree of vetting by a federal

47:31

agency so yeah it would be a higher bar

47:33

so if you can't if you can't get the

47:35

concealed carry permit then you're not

47:37

going to be be able to pass mustard for

47:40

FFL and then if you're someone who let's

47:42

say you're an Ohio resident and you have

47:44

an Ohio license I think those folks have

47:47

to get a visitor's license when they

47:50

come in to pee right if they're going to

47:51

carry depends on the reciprocity

47:53

agreement a mid you I know it's it

47:55

differs by state so you the example of

47:57

Ohio so I would have to take a look at

what their reciprocity rules or if there

48:02

is any reciprocity rules between and if

48:04

there isn't then they're not allowed to

48:05

bring or well yeah I mean again some I

48:09

would have to look because even even the

48:11

reciprocity agreements there some of

them are um you know depending on the

state they're not the same doesn't you

don't get cart blanch as if you you have

the same rights in your state some are a

little bit limited you know so it would

vary by state I would assume Neil let

if you're transporting a firearm over

state lines you better know what you're

doing right so can someone who has a

license uh in Ohio kind of use that FFL

license to then not have to deal with

that's part of being specific and and

is the theory then going to turn every

buyer in Harrisburg into a seller

automatically is that what because

they're have a federal firearms

license yeah if they have to have one to

buy it suddenly we have a thousand

sellers well you you might here's the

thing you might already have a thousand

sellers now just operating you know

under Cloak and Dagger um you know so

and again there's some folks that and

and too we we've seen with even um go

back to the Biden Administration with un

ival background they issue rules around

Universal background checks so it's you

know breaking out the distinction

between someone who I might just have a

gun that I'm just I'm not a I'm not in

the business of selling right so they're

making a distinction if you are in the

49:39

business of selling versus hey I'm

selling this fire this one off firearm

to knel because I no longer have a use

for this doesn't mean that I'm in the

business of selling but I'm selling this

gun to Neil just because I'm offloading

or other otherwise so there you know and

again I'm sure that's going to be

something that that will be ated by the

US Supreme Court even when it comes to

um selling but yeah you have but I say

all that to say is you have some folks

that um are operating out of their homes

of that and I send the paper form to the

state police right but the issue with

that is 2024 for starters so we still

sending paper forms and then you have

the state police to have this huge

50:34

administrative backlog so being able to

50:36

trace a gun it may take six months for

50:38

the State Police to process this uh this

50:41

form and by the time dozen crimes have

50:45

could have already been committed and we

50:46

don't have the ability to trace th those

50:48

Firearms so you know I I think that to

50:51

to Neil's point is um we we'll get you

50:54

hopefully have a lot more guidance that

50:56

dict Ates um how we address this in

50:58

Pennsylvania but in the meantime and to

your point too there are going to be

some things that um will be novel that

we have to kind of be a little agile

with uh but again this is meant to be a

stop Gap uh until which time the state

and the FEDS um get a handle on

weapon and if there are reciprocity

agreements between the states that's

the gun uh the source was sourced from

purchasing a unfinished firearm Bill kit

or selling a unfinished firearm Bill kit

AKA ghost gun that you would have to

obtain that federal firearms license and

again kind of part of what this issue is

is because at the example I used earlier

there's nothing that stops me today from

purchasing 10 ghost gun kits for

$300 and sell now obviously I'm selling

them illegally but selling them to

53:30

someone at a marked up price with no

53:32

accountability whatsoever so the the the

goal is to at least have some a greater

53:36

degree of accountability uh and ensure

53:39

that the people that are taking

53:41

possession of these weapons and more

53:43

importantly selling these weapons are

53:44

lawful and and that those transactions

53:47

are lawful okay and as far as

53:49

enforcement how do we enforce making for

53:51

sure that people have that federal

53:53

firearms license great question so as I

53:56

said you know obviously that's the

53:58

that's always the question when it comes

to especially public safety issues or

54:01

anything relative to to dealing with the

crimes code is enforcement so in this

case you know I said there's a a few

different methods and you know this is

where uh the community and law

enforcement um can be creative

especially you guys with the law

enforcement advisory committee um that's

that's the thing right so so you know

especially with entities like that you

the things I said is obviously know

self-regulation you know obviously we

know when a law you know people know for

people that are that operate in a gray

just like for a lot of folks here today

and and those are viewing a lot of and

even some of my colleagues when to talk

about ghost guns you know um especially

for my apolitical friends you know they

have no clue about this right so the

more educ educated they are they're able

to see things in the home especially if

you see these parts of guns that may

look resemble like a gun like a kid a

toy or something um and then too we

55:48

talked about you know every for the most

55:51

part if you got a kid that's over 12

they usually have some kind of card or

55:55

whatever especially for Roadblocks or

55:57

whatever y'all be giving these cards for

55:59

so even having parents be vigilant about

uh the bank statements right you know

seeing exactly what this transaction is

so um and then we also talked about

lastly Philadelphia sued two of the

56:11

largest uh uh ghost gun kit makers and

56:14

we're able to broker an agreement where

56:17

they're going to Le stop selling fire

56:19

out those kits in Philadelphia for

56:21

finite period so those are some of the

56:24

ways to be able to enforce it obviously

56:26

and to add okay to add um you know one

56:30

of the other things that we would be

56:31

what I would be trying to do is to uh

56:34

sit with the president judge to bring in

56:37

the the

56:38

DJs you know because sometimes you know

56:41

uh just like with with codes sometimes

56:44

uh these ordinances and uh citations and

56:46

things get kicked over to the DJ's

office and they end up getting kicked

out so uh we just want to make sure that

we're we're uh in clear communication

with them as well and one of the biggest

things as again is um educating the

community about it so that's one of the

other pieces to the enforcement and and

one other piece too because this this is

undervalued is um I talked about um sort

of like what amtr does they see

promoting us you know a healthy form of

snitching these days right you know

whether that's some kind of platform for

report that hey I've seen this or I've

heard this I know as someone in the past

life I we know kid youth they share new

guns like they share sneakers or new

very anxious to share that information

so a lot of people so I've said this

before um people know who have the gun a

lot of community people know who have

the guns especially illegally so you

know that kind of goes back to being

able to do a specific campaign um and

again you know again this isn't the um

this isn't going to be a Panacea to the

issue here uh but at least you got have

some degree of flexibility at least

57:58

currently um to to be more proactive and

Hands-On uh around a firearm safety

issue where um under the current state

preemption uh statute you you guys

haven't been in years
