uh yes so the applicant proposes to

construct transitional uh housing

actually think it's permanent yep sorry

permanent uh housing uh development for

3:09

homeless individuals featuring 32

individual tiny homes a 2400 foot

Community Center offering services for

residents and Associate site and access

3:17

improvements project received zoning

3:19

hearing board approvals for the required

3:20

zoning relief requests at their October

3:22

21st 2024 meeting property at 1103 South

Front Street is a 15 acre lot which is

3:28

largely vacant although it's still

3:29

obtain some of the building foundations

3:31

and site infrastructure from when the

3:32

property accommodated a steel mill

3:34

currently it accommodates a critical

3:36

connection of the capital area greenb

3:37

but little else in the way of bment

3:39

interactive uses there's currently a

3:41

subdivision application in the review

3:43

process which will result in the

3:45

partitioning of the existing property

3:46

into two tracks an 8 and 1 half acre lot

3:48

and a 6 and 1 half acre lot this project

3:50

will be located on the lad lot to the

3:52

South the property is bounded by the

3:54

property 1101 South Front Street to the

3:56

north railroad tracks to the east

3:58

property at 1105 South Front Street to

4:00

the South and ssan Street ssan River to

4:03

the

4:04

West the planning Bureau staff

4:07

recommends the request be approved with

4:09

the following conditions uh the

4:11

applicant should ensure that the tiny

4:12

homes will be ADA Compliant via zero

4:14

step entries and the community center

4:16

will likewise have Ada access to ensure

4:18

that they're able to accommodate as much

4:19

as the population as possible uh the

4:21

applicant must install landscape

4:23

screening along the western side of the

4:24

proposed parking areas to prevent

4:26

headlight spillover into residential

4:27

units uh the plane bu recommends that

4:30

the app can continue coordination with

4:31

the City Arborist regarding required

4:33

landscape screening and trees retention

4:35

of existing mature trees and the

4:37

installation of native plants and

4:38

pollinator plants in landscaped areas

4:40

throughout the site and more

4:41

specifically around the proposed storm

4:43

water detention basins uh the alant rec

4:46

the plan be recommends that the

4:47

applicant install the required bike

4:48

parking near the main entrance of the

4:50

community center and that it be

4:51

sheltered for the benefit of staff and

4:53

volunteers residents in the tiny homes

4:54

can store their bikes and their units

4:56

and finally the applicant should

4:58

coordinate with with the owner of the

5:00

property to the north of the site to

5:02

ensure to secure easement agreements for

5:05

Access through their site and provide

5:06

such documentation to the planning

5:08

Bureau planning Bureau staff recommends

5:10

the request be approved for the

5:11

following reasons the applicants have

5:13

received approval from the zoning

5:14

hearing board for the various relief

5:15

requests needed to effectuate the

5:17

project as proposed uh the proposed

5:19

project will meet a critical need

5:20

housing for homeless individuals will

5:22

provide units with full bathroom and

5:24

kitchen facilities that have improved

5:26

their that improv their standard of

5:27

living and will further development a

5:29

housing typology that has been proposed

5:31

and completed for other sites in the

5:32

immediate area uh the project represents

5:35

a continuation of recent development

5:37

projects in in this area intended to

5:39

provide accommodations and services for

5:40

those experiencing homelessness and

5:42

finally if the recommended conditions of

5:44

approval are adopted the proposed

5:46

project will provide improvements that

5:47

benefit residents including better

5:49

bicycle infrastructure and increased

5:50

vegetation and ecological

5:53

commission who have any questions or

concerns commissioner

here there's a letter here uh from what

was it January 3D I think asking for a

lot of specific exceptions and waivers

to a number of

items

yeah um so I you know generally speaking

uh these waivers are um requested are

actually pretty standard uh for what we

7:04

get um in developments and frankly the

7:07

applicants have probably gone you know

7:08

above and beyond uh with like the space

7:11

between buildings uh things of that

7:13

nature that you know normally we don't

7:15

even kind of do a review of on our case

7:18

um so from the you know planning

7:21

bureau's perspective uh for the most

7:23

part um the traffic impact study that's

7:25

not required because it's not going to

7:26

be 40 Peak uh trips per hour uh STM

7:29

Water Management facilities I mean

7:31

that's something that actually the um

7:34

capital region water would have to sign

7:36

off on anyway so that's kind of more

7:38

within within their purview um and so

7:42

you know we find uh the proposed waivers

7:45

to be acceptable on our end and

7:47

otherwise would have to be addressed

7:48

through um you know capital region

7:51

water okay I guess the the one question

back in back in the day we we had a city

engineer who

reviewed those requests on that we don't

8:05

have I I didn't we don't have anything

like that anymore right uh no we do um

so I had I believe in the uh at the back

uh the city engineer did review uh the

8:13

request and did not uh the did review

8:16

the project and did not make any

8:17

recommendations noted in here I just

8:19

missed it uh I think it's like right

before um

the right before after the comprehensive

8:25

plan uh portion of the case report

it's under page seven of the case report

yeah uh recommending approval without

8:36

additional conditions without additional

8:39

extension which is a roadway now going

through three different properties pass

pen dot yeah um it is not it is a uh

private drive from basically the

intersection with Sycamore Street uh

through the pendot so it's not even a um

uh public right of way through the pend

do property see okay so okay is that the

one you I wasn't sure if you were when

you mentioned the easan agreement I

wasn't sure if you were referring to the

Front Street Extension or that um

emergency the gravel road on the the I

guess that would be the western side of

the properties yeah um that was for

basically any easements whether they're

utility easements or access easements um

and it's more of a I would say formality

uh we had we've had people inquire um

about uh any easements once the VOA

facility was um approved uh and

constructed and so I just wanted to make

sure in the future if we got you know

requests for these or if the property

changed hands either this property or

11:10

the one to the north and we had uh you

11:12

know those parties asking us for those

11:14

for their own legal purposes that we had

that on file yeah yeah yeah I would

agree because I at this point if that's

11:20

technically a private driveway that

11:23

belongs to VOA then what's preventing

11:26

them you know at some point either in

11:29

the middle of it yeah saying you guys

can't drive up here if let's say there

starts to become an issue with um folks

that are occupying spaces on either

property yeah Anda says I don't like

this anymore I don't want your people

coming up here what so so vpa when the

original subdivision for vopa was done

and and Jeff you can correct me wrong

here but they they did provide with that

subdivision the public access for South

Front Street so it's so it

is recorded in an easement as public

access the South Front Street extension

and then okay the southern portion of

that or Western portion I guess on the

on the bottom of the site that's record

also recorded as emergency access okay

and access for utilities okay so both

the top and the bottom have already like

been recorded as they're not roads right

they're not public roads so that the

12:24

city doesn't take care of them right

it's the responsibility of the owners

but that recording will will follow

through with this with this plan and

with the T to job as well okay has that

and on the western

12:38

side

right yeah all right that's uh that's

good to know glad that's been been

addressed and uh at this

point I know we had conversations back

during the sketch plan and the variance

12:55

phases of this project along with the

12:57

other projects that has the green belt

um bike PA the pathway has there been

any movement one way or the other is it

possible to utilize this extension as

13:09

access for biking Where Do We Stand um

13:12

to my understanding uh based on the um

13:16

review during the tonsil Towers project

13:18

tonso Towers intends on having Gates and

13:21

fences across these which will

13:22

effectively prevent Public Access and I

13:25

think um the capillaria green belt

13:27

Association is moving forward as though

13:30

that will be the final configuration of

13:32

the site and so they have been uh

13:35

looking at alternative alignments I

13:37

don't know that there's anything formal

13:39

as far as um a study underway uh they've

13:43

definitely they definitely know where

13:44

they want to go I think but they don't

13:47

um have the the formal uh engineering

13:49

study complete certainly I don't know if

13:52

they're in discussions I haven't had any

13:53

conversations with them in a little

13:54

while so um I I do believe they're in

13:57

the process of fundraising for that uh

13:59

study um and again I think they've had

14:01

conversations with the owners of the

14:03

property through which the the

14:05

alternative alignment would run um which

14:08

seemed to be going well I guess as well

14:11

as as well as they could um and uh you

14:14

know it's their they seem optimistic uh

14:17

the green B Association seems optimistic

14:19

that they will be able to find this

14:20

alignment and at this point it's a

14:22

matter of engineering and money okay

14:24

understood nothing that would pertain

14:26

then to this this subject of property I

14:28

can say is an engineer looking at it

14:30

they did share that with us and uh there

14:34

is a request for the city to assist in

14:35

an application for funding um so all

14:38

that's ongoing um so they I think I saw

14:41

the numbers between two and a half and

14:43

three million that's one set of numbers

14:45

you know I think without an engineer's

14:47

actual thing you know and uh there's I

14:51

think a question about whether things

14:52

will be donated or not in terms of

14:54

Rights uh so there's there's just

14:56

they'll be moving Parts but it looks

14:58

like they are on track to solve their

problem relocating got it okay that's

so the one there's one item in the uh

conditions of approval actually there's

a couple here in the conditions of

approval just wanted to go over have a

um so this is really regarding the

uh approval with conditions item one

that Jeffrey had stated uh which is I'll

just read it again so we can read it

record the applicant should ensure that

the tiny homes will be ADA Compliant via

center will likewise have Ada access

possible um so our initial submission

and submission that was reviewed did

include um the houses at grade basically

to allow not even a a rant isn't wasn't

really required right it was just a zero

step like you'd go into any grocery

store something like that um in the

process of getting some quotes there's a

significant almost double Savings in

16:54

price and correct me if I'm wrong KY

Wendell if we move to a like

pre-constructed preab building which

would require since they come in as one

17:04

item they need to be set on basically a

17:07

small crawl space that would require um

17:10

handicap rant to be installed which is

17:13

still which still provides at zero

17:14

access I think what we would like to do

17:16

is and just change the wording a little

17:18

bit U we'd like to recommend that the

17:20

Planning Commission change that

17:22

recommendation uh to

17:23

state will be ADA Compliant throughout

17:26

the interior and provide accessible zero

17:28

step alternates for those residents

17:30

requiring such access So the plan that I

17:34

showed you which would be the ramp

17:35

basically the ramp length that would be

17:37

required it's basically a 30 foot long

17:39

ramp and that kind of switch switches

17:41

back so we we are certainly going to be

17:44

provide all the houses with internal Ada

17:47

access and then where required where

17:49

there Ada accessibility necessary uh

17:52

provide this alternative access um that

17:55

way we're not installing them at every

17:56

single house that's a kind of a big ass

17:59

um for the for the site so just kind of

18:02

wanted to add that in there C can you

18:05

clarify that please because if it's new

18:09

construction the ADA requirements for

18:12

it's a residence though it's it's an

18:13

individual residence

18:16

so well I guess that's one way to look

18:19

at it but you you have a center you're

18:21

putting there are they going to own the

18:25

residences you know so are you going to

18:28

put them in

18:29

as residents switch over I mean I mean

18:32

I'm just asking the Practical side of it

you know it's

uh

uh I'm going to reserve the right to

look at that question between here and

18:41

City Council on on the

18:44

Ada without offering an opinion at this

point in time uh but the city is

18:49

generally trying to make sure that

18:50

everything becomes ADA Compliant because

we're 40 years behind so and I think

18:56

looking at um the new um sketch plan

18:59

that the applicants have provided um

whether that's yeah and and I think you

19:04

could even do it if if it's between

19:06

units like this like have another one

19:07

over on the other one so maybe it's

19:09

you're only doing one set of ramps

19:10

between every two buildings or even for

19:13

half the buildings I I um what and

19:16

whatever is required by Ada uh my main

19:18

concern was uh um and again looking at

19:20

the elevation plans of the tiny homes it

19:22

did look like they were but I just

19:24

wanted to make sure that was clarified

19:25

but looking at the um Community Center I

19:28

did didn't see ADA compliance I saw in

19:30

fact they each seem to have like a

19:31

little threshold or step up so that was

19:33

like more of my concern was that the

19:35

community center itself was Ada compli

19:38

yeah and if there are great changes

19:39

required for that uh reason or we'll add

19:42

that ramp there there is enough space at

19:45

the at the main entrance you can see

19:46

gets a little wider uh at the entrance

19:49

where toward the parking lot so we could

19:51

certainly provide the Ada accessibility

19:53

that ramp

19:55

there you kind of talking about

19:58

elevations there kind of sparked my

20:01

curiosity what is flood playing at this

20:03

site um so the FL I forget the elevation

20:06

exactly it's about four or five feet

20:09

below the kind of embankment where it

20:12

drops down the dark green kind of where

20:13

it drops down to the river it's about

20:15

four or five feet below

20:18

there and that's and that's which flood

20:20

plane for which event St 100 Year FL

20:23

that is it is that high there yeah um

20:25

and actually the 500e flood plane

20:28

for FEMA does does extend into the

20:30

property so while that's not really you

20:33

know why we're recommending this like

change to the ramp height it would

20:38

actually help in that manner as well it

20:39

would be outside the 500 plane yeah I

just know for other applicants in the

20:44

past we've um I think one 30 inches

20:47

above the certified flood elevation for

20:50

the lowest occupiable floor uh so a

20:53

flood constructed building yeah our free

20:55

board which is the kind of buffer you

20:57

provide above the Bas flood elevation is

20:59

18 in uh here in the city for new

21:02

construction is it 18 now yep okay and

21:04

we so we will be above that height for

21:05

the for the 100 for all the first floors

21:08

even if they're the lower even if

21:10

they're and and to and to clarify uh the

21:13

entire site is in the zone X the 500e

21:15

flood plane but the Zone AE flood plane

21:18

the 100e flood plane uh is west of the

21:20

western emergency route and uh east of

21:23

where their driveway and parking area is

21:25

so uh no part of it encroaches on their

21:27

proposed development footprint okay I

21:30

figured you had you've done such a

21:32

thorough job and everything else but

21:33

just curious yep it's always interesting

to watch what comes Downstream on Front

21:38

Street when the water High that's all

yeah thank you um so another another

item was uh item two which uh describes

the the request for landscaping kind of

between the parking lot and then those

houses that have the rear facing the

parking lot so um we're fine providing I

think it's actually a really good point

right we don't want head or yeah car

headlights going to the backyards um so

we'd

like it to State rather than just

Landscaping landscaping or opaque

fencing because we have the fencing

there we we might provide a fencing

instead like solid fencing there in that

section and then just a just a

clarification on your item number five I

think we talked about this already but

we we will the access to vpa is already

guaranteed through their easements on

the South Front Street and then the

22:37

emergency access out yeah and I think I

think it was more and I do recall seeing

um the E the easement documents for vopa

but there will soon be a different

property owner between um the penda

22:50

facility and your property so I don't

22:52

know whether vopa's easements override

22:54

all that or whether you have to have new

22:56

easements with a new property owner and

22:58

if nothing changes and the easements

that have been filed are you know in

perpetuity for all of the projects here

I think that's fine I just want to we

just want to make sure that that's clear

again for future uh planning Bureau

staff and if the requests come from

anybody

other um I guess no the only other thing

was and I think um ver you had mentioned

it that the waivers

while they're kind of brought up kind of

that confirmation the waivers you know

recommendation of approval with the

waivers as as request in and and we and

we would be fine with um we would be

fine with uh grany approval of the

waivers that we have the right

to um if it's crw and they say this

isn't Inc conformance uh we need you to

do X Y or z um I wouldn't want our

24:05

determination or the the planning

24:06

commission's determination to overrule

that great I think what yeah and what

I'm looking for then is just the the

board's kind of acknowledgement that

from our perspective you're you're

24:15

comfortable with the with the waivers

24:17

asking for but obviously it would be

24:19

determined by

24:21

crw still more and also the npds permit

24:24

so am I correct neither crw nor the

24:27

Dolphin County commission has weighed in

yet not yet I it and that was frankly my

24:32

fault I was a little uh that that's okay

but I'm saying we we do have to rely

upon both of them as we review a project

24:39

it's not really it's not really a our

24:42

discretion to push them aside you know

24:44

they're separate government agencies and

24:46

uh you know um I do not find crw as a

24:51

general rule to be willing to wave much

24:52

of anything so so they they they waved

24:56

they specifically did wave the um both

the vopa site and the tunnels to Tower

site for the two storm water related

items we were asking

for but I certainly agree like in

25:09

general people on standard for a reason

right um and and I would get and frankly

I would guess that um these are in

our uh Soo because it's from 1988 um and

that was when we still had a city water

25:24

department which would have handled all

25:26

this stuff and so there it might not

25:29

even be applicable as far as the soo is

25:32

concerned that we would have the

25:34

authority to ran waiver or even that

25:36

they would request that from us so um

25:40

you know I I I'm fine with uh the

25:43

waivers requested that the city has any

25:46

you know authority to approve um but you

25:49

know would want crw to weigh in on

25:52

their and when you referenced earlier I

thought I heard someone say this is the

sewers private did I hear that right are

the other two

private yeah okay so and what what that

means it's basically VOA who installed

26:15

that private line from their site to

26:18

connect with the public sewer so oh I

okay homeowner that's responsible for

their private line gotcha but it's a

pretty pretty long private line pretty

right so in our in US discussions with

crw we'll need separate permission from

vpa in order to be able to tie in as as

we have currently shown on utility plan

we could we could tie separately in um

if they wouldn't allow that but it seems

like their

favorable that's also why they need to

26:51

access

these gotcha so it's uh we have meetings

coming with with um RW which they are

26:59

under a 40-year consent degree to get

the system in place which we are under

27:05

as well and you know they want to have a

27:06

next steps kind of discussion so I don't

really know uh at least in my meetings

they didn't really feel like they

were willing to do anything that someone

could put and say you're not complying

with h the consent degree

so any other

layout of the building uh they are the

focus of phase one um is reconstruction

of the brick building um on the same

30:59

footprint um in a

historically um historic appropriate
