property is a corner lot at the corner

of Hunter Street and South 17th Street

streets uh there is no uh parking on

site uh currently um the applicant I

believe lives next door and is the uh uh

intending to purchase the proper

property uh and establish the one chair

barber shop on the first floor um of the

of the building um in the recent past uh

the board has reviewed similar proposals

uh one being for 2310 Green Street in

which uh they established a one chair

barber shop in the rear um detached

9:49

garage of the property um and uh one I

9:53

believe 1918 zarker Street uh which is a

similar proposal row home um with a

9:58

first floor one chair Barber shop um and

uh in both of those cases um you know

the both required special exceptions um

with respect to uh the off street

parking requirements it should be noted

that obviously as a um either uh the

applicant living on the propert or in

10:17

the property or next door where he

10:19

currently lives um they won't be driving

uh to the business they'll clearly be

10:23

able to walk so that kind of removes uh

one of the required off Street uh

10:28

parking spaces

um and otherwise uh

10:34

the proposed use I believe will require

10:37

four total spaces so that is what he was

10:39

requesting relief from from four off

10:40

street parking spaces uh the um planing

10:44

Bureau notes again that uh there is

10:46

Frontage along Hunter Street um on which

uh customers can park um however we also

10:55

note that uh as a barber shop and which

10:58

is a fairly um you know Common business

and proposal in the city it's not really

11:02

a destination business and so it's

11:04

likely that much of the applicants a

11:07

clientele will come from the surrounding

11:09

neighborhoods uh and will be able to uh

11:12

walk or uh potentially bike um from

11:15

their homes or businesses uh to uh

11:17

patronize the applicant's business um so

11:20

with that being said uh the Planning

11:23

Commission recommends that the zon

11:25

hearing board approve the request with

11:27

the following conditions uh the will be

11:29

limited to a single chair may not expand

11:31

Beyond one Barber to ensure impacts from

11:33

the proposed use are minimized and to

11:36

ensure the property retains an overall

11:37

residential character in use um and then

11:40

the applicant must install physical

11:41

obstructions along the curb along the

11:43

frontage with Hunter Street which will

11:45

prevent illegal sidewalk parking and uh

11:48

if you visited the site or just looked

11:50

at it on Google streets view you'll know

11:51

there's a lot of sidewalk parking um

11:53

that's pretty rampant there um there is

11:55

parking on both sides of Hunter Street

11:57

here uh pretty much room for one uh

vehicle to to go between the parking uh

the parked vehicles but it's pretty much

12:04

a dead end street so even though it is

12:06

two-way there's very limited amount of

traffic on it so it's not like um having

12:12

people park on the street and having it

be narrowed to one driving lane would

really um restrict traffic or cause

backups or anything like that so uh the

request for um you know relief from off

12:24

street parking should not create adverse

12:26

impacts on the surrounding neighborhood

uh and then the Planning Commission

recommends the zoning her board approve

the request for the following reasons

property exists in a mixed use Corridor

with nearby residential commercial

institutional and Industrial uses and

thus the proposed use should not have an

adverse impact on the neighborhood The

run a homebased business focusing on

serving a local clientele and uh the

12:48

Planning Commission and Zoning hearing

board have heard and approved similar

proposals for homebased barber shops in

other um somewhat similar use es or more

business related uses of buildings on

that particular area of the street where

that uh building was located um so I was

just wondering what are your thoughts in

terms of other business use in that

16:13

specific Corridor where you know

properties that were residential medium

were are now being used in the business

sense so I think uh for the most part

there hasn't been too much in the way of

16:25

conversion of properties um just to the

16:28

South uh there's uh the Philadelphia

16:30

macaroni company I believe that's the

16:31

industrial use that was referenced um

16:33

there's Pennsylvania Counseling services

for the South and I believe there's a

16:37

church a couple blocks up on the

16:39

opposite side of the street that looks

16:41

like it was in an uh former residence uh

16:44

and then there's a pizza place um up at

16:45

the corner of 17th and Dairy Street so

um and you know there are uh

16:51

industrially zoned properties actually

16:53

at the Eastern end of Hunter Street and

16:54

we've gotten inquiries about those those

16:57

might have operated as storage units or

16:59

potentially like auto repair businesses

Sidewalk Park parking I think the uh

Harrisburg Police Department is now in

an enforcement stage uh basically no

parking on the sidewalks parking on the

street and real out um what are you do

approach that where people will not be

able to park on your sidewalk

that he will place a sign in the wall

property to inform that they can par in

the sidewalk and if he see some marking

just want to prevent it outright um and

you know something like a one foot

very similar like that um a stone or

something space large enough that you

can't drive over and space closely

enough you can't drive between them is

basically all we're looking for that

would be along the curb um nothing big

or extravagant or anything like that and

you as the applicant do you agree with

basically putting some type of

obstruction physical obstruction in the

not the in the curv

not the complete walkway but the cture

proposing um to establish

um what they have outlined in their

pastoral Counseling Services educational

classes Bible studies Church committee

33:49

meetings Church board meetings Financial

33:51

meetings Food Bank services and other

33:52

church and business related purposes uh

33:55

the planning Bureau uh determined that

33:58

the proposed uses uh would constitute um

34:00

a place of worship um the applicants in

34:03

their appeal are arguing uh that the

34:07

uses um constitute an office use uh and

34:11

not a place of worship use um and

34:13

therefore would be permitted by Wright

34:15

in the indd district um

34:19

in in the alternative um they have ad

34:23

they have argued that uh

34:26

the that the I guess proximity of these

34:29

two uh properties

34:32

um would create the hardship um that

34:36

would justify the variance request um

34:40

the planning Bureau uh determination

34:43

based on place of worship use um is

34:46

essentially that they're going to be

34:48

holding things like Bible Ser studies um

34:51

you know pastoral counseling Church

34:53

committee Church board meetings um and

34:56

that such use

34:58

are accessory to and in totality amount

35:00

to a place of worship use uh the

35:03

applicants um argument that because it's

35:07

similar because those uses are similar

35:09

to an office they argue that their you

35:10

know a law office would have a

35:11

conference room for example uh the

35:14

planning Bureau does not find that to be

35:16

a um compelling argument uh Because by

35:20

the same token you could say that if an

35:23

office for a used car dealership for

35:25

example um they had a

35:28

lot on one side of the street and on the

35:30

other side they said we're going to put

35:31

our office over there and Ed car dealers

35:33

ships weren't Lo permitted by right over

35:36

there but our office is there so it's an

35:38

office use we would say but your office

35:40

is accessory to the used car dealership

35:42

and in a similar manner all of these

35:44

Services they're looking uh to do are

35:46

accessory to the main function um of the

35:49

of the church itself and therefore we

35:51

determine it's a place of worship use

35:53

you know alternatively we would argue

35:55

that um by the app applicants logic you

35:59

would not allow be allowed to do a home

36:01

occupation use because some of it is

36:04

Administrative and office functions and

36:06

therefore would be classified as an

36:07

office use and therefore would not be

36:08

permitted in the RM District as a um

36:11

home occupation is and so when we look

36:14

at uses we don't look at the little bits

36:16

and pieces of them of oh a meeting room

36:18

well that's an you know congregation

36:20

area or an office is an office and the

36:22

parking lot is you know whatever um you

36:26

have to look at the use in the totality

36:29

of what they're doing not like pick it

36:30

apart because not only again does that

36:33

create those kind of inconsistencies

36:35

that I just noted but it would really

36:38

complicate just the administration of

36:40

the zoning code to look at every single

36:42

activity that might happen as part of a

36:43

business and say well what's permitted

36:45

and what's not you have to look at it in

36:47

its totality uh and that's why we made

36:49

the determination that we did um and

36:52

then our recommendation of denial was

36:55

based on the fact that there's nothing

36:57

um in inent to the property itself that

36:59

does not allow it to be used for any of

37:01

the uses permitted by wri in the um indd

37:04

the industrial district and therefore

37:06

the variance is necessary to allow the

37:08

use to go forward um you know there are

37:11

tons of uh especially Auto oriented uses

37:14

like Auto Repair Auto Sales that could

37:16

be done on the property and we get

37:18

requests for those you know on a daily

37:20

or weekly basis really um and so we did

37:23

not feel that the request was justified

37:25

uh in their deliberations the Planning

37:27

Commission

37:28

sided with the applicants um agreeing

37:31

that the activities that they would have

37:33

on site would constitute an office use

37:36

distinct from um the place of worship

37:39

use that is their primary facility at

37:42

2217 Dairy Street um and so uh with that

37:46

being said uh the Planning Commission

37:52

um recommended that the zoning hey board

37:54

approve the request uh with the

37:57

following conditions that the applicant

37:59

is not permitted to conduct worship

38:01

activities of the subject property um

38:04

and that uh they recommended that the Z

38:07

he board approve the request for the

38:08

following reasons ough the Planning

38:10

Commission feels the applicant cannot

38:12

meet their burden of proof with respect

38:13

to establishing a place of worship use

38:15

on site they feel that the activities

38:17

proposed by the applicant do not

38:18

constitute such a use and instead

38:20

comprise an office use permitted by

38:22

right in the indd district thank

project yeah um I think um well first of

all I didn't do this last time so I just

really done in the city um we're just

trying to do the same a lot of people

maybe don't know about our church we've

been around since the 1890s um every

time we've moved our church it's not

because of wanting to get bigger better

faster it's the service our started

daily street so if you ever know where

39:47

the YWCA is across the street there we

39:48

have a marker was our first building we

39:50

work in orphanages we work toah homean

this year um when we combine churches we

39:56

went to 20th in Chestnut so that was our

39:59

old building we gave it up to another

40:01

congregation and we moved to what

40:04

essentially is an old car dealers even

40:06

our building now um wasn't necessarily a

40:10

place of worship when we mve into it we

40:12

purchased it was a car dealers um so I

40:15

appreciate um you know Jeffrey's

40:17

argument but I think that totality thing

40:19

is what kind of flipped with planning gr

40:22

because we said that you know all we're

40:24

doing now is an expansion of what we're

40:26

already doing our current building is

40:28

considered a place of worship we still

40:30

hold food pantry we still hold a medical

40:34

clinic we have blood drive that comes in

40:37

we have English language learning

40:38

classes and one of the things I think

40:40

switched them was I said so what you're

40:42

telling me is that this is an office and

40:44

it's a church office if I'm having a

40:46

conversation with somebody they have

40:47

something going on in this new building

40:50

I wouldn't be allowed to advise them I

40:52

would have to walk across the street

40:54

with them and and and counsel them there

40:56

because apparently it's okay in the

40:58

first building but not the second

41:00

building so I think that's what kind of

41:02

switched them because for them was this

41:04

is an extension of who we are so yes it

41:07

might be Zone differently but

41:09

essentially what we're doing is moving

41:11

some of our surface across the street

41:13

because we grown that currently in our

41:15

building we have one office building in

41:16

nine one office that has a close door in

41:19

mine sta um if you were to come to our

41:22

building it's right across the street we

41:23

have rookies and then there's a car wash

41:25

or right across the street if you walk

41:27

into to that entry point again it's all

41:29

open so that makes it really hard people

41:31

to do their work um so we had looked

41:34

years ago to possibly building these

41:36

offices in place and doing some of the

41:38

things that we would get at 2151

41:40

Greenwood and it was cross prohibited um

41:43

that was the first thing second thing

41:44

was we would lose space because of what

41:46

we're doing with the community because

41:47

we'd be carving into our current square

41:50

footage so in purch of this building if

41:52

you look at the totality of who we are

41:54

how we serve we're not changing anything

41:57

are we're just expanding so my staff for

41:59

example can now be able to close their

42:01

doors we're expanding so our English

42:03

language learning classes don't have to

42:05

have a of 100 we're expanding because

42:08

again this is how we serve our city and

42:10

yeah the the place of worshiping I get

42:12

is tricky but it's really really hard

42:14

because in one sense everything we're

42:16

doing now in the current building we're

42:18

just asking to be able to do it across

42:20

the

street let me let me just inter because

I in in looking through it right the

Planning Commission seemed to be okay

with a lot of things I still think the

42:35

one thing that they did have an issue if

42:37

is if a substantial amount of pastoral

42:41

counseling was going on over there I

think that was kind of the one thing

42:44

that they still were though saying would

42:46

be a place of worship but all the other

42:48

things not and I think somebody said

42:51

well you know I don't think that's going

42:53

to be going on you know that off

42:55

somebody may be just coming coming in

42:58

that that that's the way I read that

summary I thought but other everything

um it's you know I think evident that at

one point in the past p uh the property

was operating as two units I think it's

it's been owner occupied as far back as

the County's records go which is the

2001 um so you know that's right there

kind of one thing we note when looking

at things like this is it a if it's a

something like that clearly it's a

rental of and then you're just asking

how many units whereas this is uh has

always been under occupied since 2001 uh

we do have a record of um it being two

units back in 2001 in the city's records

however in the intervening 23 years or

so there's been no um you know rental

inspections done that would um confirm

that this is two units uh as as would be

required uh you would have to have um at

least semi-regular inspections of both

units to um affirm that it's still

maintaining Cod compliance and things of

that nature um and so uh the current

applicant um recently purchased the

1:36:57

property and um was looking to U

maintain those two units and it was our

1:37:04

determination that uh due to the two

1:37:07

plus Decades of at least no records of

1:37:10

there being multiple units the former uh

1:37:14

multif family dwelling use had been

1:37:16

abandoned per the zoning code and thus

1:37:19

um the applicants needed to go through

1:37:21

the necessary zoning relief uh to

1:37:24

reestablish the two units on site um and

1:37:27

the applicants have you know

1:37:28

documentation that they'll be I'm sure

1:37:30

discussing and presenting to the board

1:37:32

um uh to you know from from their

1:37:36

perspective um but the that being said

1:37:39

uh the planning Bureau is supportive of

1:37:42

the uh proposed use you know one of the

1:37:45

uh big issues um when you're talking

1:37:47

about conversion of properties is the

1:37:49

impact on parking in this case they have

1:37:52

a three Bay garage at the rear of the

1:37:54

property um it should be noted that that

1:37:56

garage doesn't actually have like a

1:37:57

formal driveway uh there's a grass strip

1:37:59

between uh what would be I guess the

1:38:01

driveway apron and and the street um and

1:38:03

it's a pretty kind of steep topography

1:38:05

there uh but it's clear that there's

1:38:07

three Bays there and I'm sure somehow

1:38:09

got into those bays in the past um so

they have the um you know off street

1:38:15

parking to handle this they you know

1:38:17

clearly have a um uh fire escape on off

1:38:21

the rear of the property uh and as

1:38:22

they've shown in the their um photos

1:38:25

there are you know two separate

entrances uh and if the previous

1:38:29

property owner it's not just the

1:38:30

previous owner Mr Clark there was

1:38:32

another one before that for 18 years or

1:38:34

so I think um had they you know

1:38:37

maintained the even semi-regular rental

inspections we would have just

1:38:42

determined that this was you know

1:38:44

continuing non-conforming use um so with

all that being said uh the Planning

1:38:51

Commission recommends that the zon

hearing board approved the request with

1:38:54

the following conditions if granted

zoning approval to move forward with the

1:38:57

project as proposed the applicant shall

1:38:59

allow the codes Bureau to perform a

comprehensive inspection to identify out

any outstanding code violations that

will receive approval for all necessary

city permits prior to receiving a

certificate of occupancy uh because they

are not requesting relief from the off

street parking requirements and have

reference the detached garage and

affirming the provision of the required

off street parking uh the applicant must

construct a driveway to provide access

to the three garage bays in the rear of

the property as no such access currently

exists um it should also this work

should also ensure that there's an ada8

compliance sidewalk uh it's maintained

along Edward Street there and then the

applicant will coordinate the Department

of Public Works to ensure the account

billing is updated to reflect the

proposed change in use uh the Planning

Commission recommended that the zon he

board approved the request for the

1:39:40

following reasons the zoning relief

requests for the proposed unit the use

1:39:44

are warranted by the history of the

1:39:45

property which is operated in the

1:39:47

pastest two units uh and the project

will address the primary concern of the

public regarding such conversions

specifically the impact on parking

available to existing residents through

1:39:57

the provision of the required parking in

1:39:58

the detached garage of the rear of the

property and due to the availability of

1:40:02

ample on Street Park y on the Frontage

of the property with Edward Street thank

were mentioning um as far as uh any

documentation being filed in inspections

like um that would be as being continued

to be uh rented right I mean if it was

property is located in the city's

residential medium density District uh

1:44:44

we had uh Jeff the planning Bureau CH

make an interpretation that the use is

1:44:49

actually a single family dwelling and

1:44:51

not a multi family dwelling unit we are

1:44:53

here seeking an appeal of the zoning

1:44:54

officer determination or in the

1:44:57

alternative a special exception coupled

1:44:59

with two dimensional variances to permit

1:45:01

the use we did receive a favorable

1:45:04

recommendation from the City Planning

1:45:05

Commission already unless you have any

property clearly indicated it's a two

unit property uh and the letter from the

1:55:49

prior owner indicates that he never

1:55:51

abanded the multif family use and never

1:55:53

intended to and sold the property as

1:55:55

such and in Pennsylvania to abandon a

1:55:58

use requires both uh intent and actual

1:56:01

abandonment there does appear to be some

1:56:03

confusion on the owner's history but as

1:56:05

the deed indicates Melvin Clark gained

1:56:06

half ownership of that property in 1977

1:56:09

and when the other owners died he gained

1:56:12

complete

1:56:13

ownership finally if the board does not

1:56:15

want to Grant the appeal and grants the

1:56:16

alternative relief uh just a comment

1:56:19

about the recommended driveway condition

1:56:21

the last of formal access uh we would

1:56:24

argue is likely a non-conforming

1:56:26

condition and imposing this condition

1:56:28

places another significant burden on the

1:56:30

applicant further pushes back this

1:56:32

timeline to rent the property out to

1:56:34

tenants uh you're essentially asking to

1:56:37

maintain the status quo as that has

1:56:39

continued to exist as it does today and

1:56:42

furthermore as indicated by the planning

1:56:43

Bureau there is sufficient on street

1:56:45

parking available along the property

1:56:47

including 150 on Edward Street and for

1:56:50

the reasons discussed

1:56:52

request you grant the appeal or in the

1:56:55

alternative special exception

1:56:58

guarantees that

questions I think my questions have been

property stays in good standing and good

shape for the other homeowners in the

area it's very important to be able to

do that so mtown Property Management all

they're going to claim that that's an

accessible driveway or accessible garage
